1996 FARM LEASE AGREEMENT <br /> THIS AGREEMENT, made and entered into this 6th day of <br /> November , 1996 by the and between the City of Pequot Lakes , <br /> hereinafter referred to as the "City" and Bill Tulenchik <br /> hereinafter referred to as "Tulenchik" . <br /> Witnesseth, that said City, in consideration of the <br /> rents and covenants hereinafter mentioned to be paid and <br /> performed by Tulenchik, does hereby demise , lease, and let <br /> unto Tulenchik, and Tulenchik does hereby hire and take from <br /> the City the following described premise situated in the <br /> County of Crow Wing, State of Minnesota, to wit : <br /> 1 . Description of Irrigated Property. The Property is <br /> legally described as follows : All that part of the Northwest <br /> quarter of the North 200 feet of the Southwest quarter of <br /> Section 23 , Township 136 North, Range 29 West , Crow Wing <br /> County, MN lying East of the East right of way line of the <br /> Minnesota Department of Natural Resources Paul Bunyan Trail . <br /> AND ALSO All that part of the West 100 feet of the Northwest <br /> quarter of the Northeast quarter of Section 23 , Township 136 <br /> North, Range 29 West , Crow Wing County, MN. That said 105 <br /> acres may change from time to time over the course of this <br /> agreement as the City and Tulenchik may agree . <br /> 2. Description of Non-Irrigated Property. The above <br /> described includes 42 acres not being irrigated. <br /> 3 . Term of Lease. This lease is for a term of seven <br /> years beginning January 1 , 1997 and ending December 31 , 2003 . <br /> Tulenchik shall be given the first right of refusal on the <br /> renewal of this contract at the end of the lease period on <br /> December 31 , 2003 . <br /> 4. Rent . Tulenchik shall pay to the City the sum of <br /> Three Thousand Dollars ($3 , 000 ) beginning March 1 , 1997 and <br /> annual payments of Three Thousand Dollars ($3 , 000) due on <br /> March 1st each year thereafter continuing until March 1 , <br /> 2003 , for rent . <br /> 5. Crops and Condition of Lease. Tulenchik agrees to <br /> plant crops on the above described property. However, <br /> Tulenchik shall not plant or grow crops which need Nitrogen <br /> fertilizer . The soil shall be sampled annually and tested <br /> for nitrogen, phosphorus , and pot ash. Tulenchik is aware <br /> of , and will comply with Minnesota Pollution Control Agency <br /> (MPCA) Guidelines for spray irrigation sites , and the City <br /> retains the right to spray in the fall when needed from their <br /> sewage effluent plant . <br /> 6. Insurance. The City shall obtain and hold in effect <br /> an insurance policy covering damages and theft to the Center <br /> Pivot Irrigation System. Tulenchik shall obtain and hold in <br />
