A motion was made by Karl Moon, seconded by John Derksen, to table this matter. <br /> ROLL CALL VOTE: Bill Habein: aye;Dean Williams: nay; Karl Moon: aye;John <br /> Derksen: aye; Tom Adams: aye. Motion carried. 4— 1. <br /> APPLICANT: Dan Gruszka. <br /> Applicant requests a conditional use permit to move a used home onto property in the <br /> City. <br /> Applicant was present. <br /> Mr. Marohn explained his Staff Report. Ms. Bittner stated that Mr. Gruszka had <br /> submitted the necessary photographs indicated in the Findings. Our Ordinance should <br /> require a cashier's check or a certified check,not merely a check, for the$2,500 bond <br /> requirement. <br /> The type of proposed foundation was questioned. Mr. Gruszka stated that he planned to <br /> use a mortared block foundation on footings. Mr. Moon questioned the use of a wood <br /> foundation being allowed in our Ordinance. Staff was to check actual amendment. (Staff <br /> Note- May, 2003, the City Council amended the Ordinance to define foundation as: "A <br /> concrete, concrete and concrete block, or treated wood portion of a structure which <br /> totally encloses the perimeter of the structure, supports the bearing loads of the <br /> superstructure and penetrates the ground providing frost protection. ") Mr. Gruszka <br /> stated that this dwelling is a single family residence to be sold, not rented. <br /> A motion was made by Karl Moon, seconded by Bill Habein, to approve the conditional <br /> use permit, based on the following findings of fact: <br /> 1. The applicant has submitted a home inspection report by a licensed building <br /> inspector. <br /> 2. There were no significant deficiencies reported. <br /> 3. The applicant has indicated that the structure is 10 years old. <br /> 4. According to the inspection report,the building is a modular building and is a <br /> good candidate for moving and being set on a new foundation. <br /> 5. The proposed foundation will be mortared block on footings. <br /> 6. There is no landscaping proposed beyond planting of grass. <br /> 7. The location and size of neighboring homes has not been provided,but they <br /> are known to be of similar size and construction within the Field of Dreams subdivision. <br /> 8. The applicant has indicated that the home is to be used as a single family <br /> dwelling. <br /> 9. The proposal would have the dwelling moved onto the property within 12 <br /> months of approval. <br /> 10. There are no threats to the public health, safety and welfare identified with <br /> this proposal. <br /> 11. The site is located to facilitate this type of process being accessible primarily <br /> by County and State Highways. <br /> Planning Commission, July 15, 2004, Page 2 <br />
