12. The proposed use is compatible with adjacent uses, which are also single <br /> family residential. <br /> 13. The property is zoned Medium Density Residential. The proposed use is <br /> allowed in the MR zone and is consistent with the intent of the zone. <br /> 14. There are no significant concerns involving water pollution from this <br /> proposal and no state stormwater permits would be required. <br /> 15. The topography and drainage features on the site are conducive to <br /> construction of a single-family dwelling. <br /> 16. The site will have its own wastewater treatment,which will be adequate for a <br /> single family dwelling. <br /> 17. The development is not riparian and is not visible from public waters. <br /> subject to the following condition: <br /> 1. Prior to obtaining a building permit,the applicant shall provide a security of <br /> $2,500.00 by cashiers check or certified check. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: Little Pine Properties <br /> Applicant requests to rezone from Wooded Residential to Urban Residential. <br /> Applicant, Ron Schaefer, was present. <br /> Mr. Marohn explained his Staff Report. Mr. Schaefer stated that he wishes to split the <br /> one acre lot into two lots. The second findings of fact is incorrect. There currently is a <br /> dwelling on the lot. There are currently single family dwellings in the area. <br /> A motion was made by Tom Adams, seconded by Karl Moon,to recommend the City <br /> Council approve the rezoning to Urban Residential, based on the following findings of <br /> fact: <br /> 1. The parcel is currently zoned Wooded Residential. <br /> 2. There is a dwelling on the parcel. <br /> 3. The parcel topography is not excessive. There are no development constraints <br /> for either zoning classification. <br /> 4. The parcel is served by municipal sewer and water utilities and will connect <br /> when developed. <br /> 5. The parcel is one block east of Highway 371 and two blocks north of the <br /> existing downtown area. <br /> 6. The draft Future Land Use Map indicates that this area should be a trasition <br /> between the urban and rural areas. <br /> All members voted"aye".
