any such officer or employee engage in the business, except that employees may work in <br /> any licensed establishment if they do not participate in the management of the business. <br /> (e On initial application for an on sale license and upon application for transfer of <br /> existing on sale license, the applicant shall be responsible for the costs incurred with <br /> investigation and the City shall conduct a preliminary background and financial <br /> investigation of applicant. The application in such cases shall be made on a form <br /> prescribed by the State Bureau of Criminal Apprehension and contain such additional <br /> information as the City Council may require. If the City Council determines that a <br /> comprehensive background and financial investigation is necessary, it may conduct that <br /> investigation itself or by contract. Applicant shall be charged with the cost of <br /> investigation, not to exceed $10,000. <br /> (€ Hearing. The City Council shall investigate all facts set out in the application and <br /> specifically facts not covered by the preliminary background and financial investigation <br /> that may be conducted by others. Opportunities shall be given to any person to be heard <br /> for or against the granting of a license. After investigation and hearing, the Council shall, <br /> in its discretion, grant or refuse an application. No on sal4 wine, or off sale license shall <br /> become effective until, in addition to security requirements, it has been approved by the <br /> Commissioner of Public Safety. Each license shall be issued only to the specific <br /> applicant, and for the specific premises described in the application. No license may be <br /> transferred to another person or entity, or another location or revised premises without <br /> City Council approval. Any transfer of stock or ownership interest without prior Council <br /> approval is a ground for revocation of a license. <br /> Section 15. Suspension and Revocation <br /> The City Council may either suspend or revoke any liquor license upon a finding <br /> that the licensee has failed to comply with any applicable statute,regulation or this <br /> Ordinance relating to intoxicating liquor. Except in cases of failure of financial <br /> responsibility, no suspension or revocation shall take effect until the licensee has been <br /> afforded an opportunity for hearing. Lapse of required liquor liability insurance or surety <br /> bond or withdrawal of required deposit for security shall affect an immediate suspension <br /> of any license, without need for action by the City Council. Notice of cancellation or <br /> lapse of current liquor liability policy or surety bond, or withdrawal of cash or securities <br /> that insure such protection shall also constitute notice to licensee of suspension of license. <br /> Any suspension under this section shall continue until the City Council determines that <br /> the financial responsibility requirements of the Ordinance have again been met. <br /> Section 16. Penalty <br /> Any person violating any provision of this Ordinance is guilty of a misdemeanor. <br /> Section 17.
