Planning Commission Report, November 2006 5 <br /> AS SUCH, THE PLANNING COMMISSION IS RECOMMENDING (5-1) THAT <br /> THE CITY COUNCIL ADOPT THE FOLLOWING ORDINANCE AMENDMENTS <br /> (additions are underlined, deletions are stricken): <br /> • Section 6.1 of the Ordinance be amended to include the Extractive Use Overlay District, <br /> as follows: <br /> 4. Districts.The following overlay districts are hereby established: <br /> Highway 371 Corridor Overlay District <br /> Recreational Vehicle Resort Overlay District <br /> Extractive Use Overlay District <br /> • Section 6.4, titled "Extractive Use Overlay District" be added and include the following <br /> language: <br /> 6.4 Extractive Use Overlay District(EX) <br /> 1. Purpose and Intent• The purpose of the Extractive Use Overlay District(EX) is to <br /> provide areas for extractive uses and associated accessory uses, such as crushing <br /> and processing as the City contains significant aggregate materials important for <br /> the maintenance and improvement of infrastructure in the area.The intent of the <br /> Extractive Use Overlay District is to allow for the expansion of existing extractive <br /> uses in areas containing primary aggregate resource potential and to designate <br /> areas in the City, where uses of this type are compatible with the surrounding <br /> neighborhood and also promote and ensure the overall health, welfare, safety, <br /> and comfort of the community and its residents. <br /> 2. Standards. All extractive use developments applying for a conditional use permit <br /> within the Extractive Use Overlay District must meet the criteria and standards <br /> contained in Section 8.S Extractive Uses and Restoration and Section 11.6 <br /> Conditional Use Permits of this Ordinance. <br /> • The accompanying map be adopted, showing the boundaries of the Extractive Use <br /> Overlay District. <br /> • Section 5.15 Land Use Matrix be amended to include a footnote for "Extractive Use" <br /> where it is listed as"C"(conditional use),stating: <br /> (11) Consistent with the provisions of Section 6.4. <br /> • Section 8.5 Extractive Uses and Restoration, Subdivision 1,be amended as follows: <br /> 1. In all districts where permitted, as defined in Section 6.4 Extractive Use Overlay <br /> District, mining shall be permitted only by CUP. Such permit shall include as a <br /> condition: a site plan, a completion plan, and a haul route plan with provision for <br /> road restoration as provided below. <br /> 5. HEARING: Ordinance Amendment to Establish Criteria for Area Identification <br /> Signs in Residential Districts, City of Pequot Lakes. <br /> At the October meeting, the Planning Commission discussed establishing criteria for Area <br /> Identification Signs for residential developments, as such criteria are not contained in the <br /> Ordinance currently.
