Planning Commission Report,August 2006 2 <br /> II. COMMENTS RECEIVED <br /> Comments on the EAW were received from two State agencies: <br /> 1. Minnesota Department of Natural Resources <br /> 2. Minnesota Department of Transportation <br /> The comments are included in Attachment A. <br /> III. RESPONSES TO COMMENTS <br /> Responses are included in Attachment B. <br /> IV. FINDINGS OF FACT <br /> 1. The developer submitted the Environmental Assessment Worksheet to the City of <br /> Pequot Lakes Planning Department for review and comment in May of 2006. <br /> Planning Staff reviewed the document for completeness and forwarded the EAW <br /> to the Planning Commission for review. <br /> 2. The entire EAW document is incorporated by reference in this Record of <br /> Decision. <br /> 3. The completed EAW was submitted to the Minnesota Environmental Quality <br /> Board(EQB)for publication in the EQB Monitor dated June 6,2oo6. <br /> 4. Copies of the EAW were distributed to the required distribution list and notice <br /> was published indicating that copies are available to the public by request. <br /> 5. Written public comments were received until July 5,2oo6. <br /> 6. The Planning Commission reviewed and discussed the EAW and public <br /> comments at the regularly scheduled meeting held on July 20, 2oo6. The review <br /> resulted in some questions concerning future road impacts in the area regarding <br /> State Highway 371 and Hurtig Road.The Planning Commission decided to extend <br /> the review period an additional 3o days, in accordance with Minnesota Rules, in <br /> order to gather more information from the Minnesota Department of <br /> Transportation regarding road impacts and mitigation efforts. <br /> 7. A meeting with representative from the Minnesota Department of <br /> Transportation, the developer, the Planning Commission, and the City Planner <br /> was held to discuss road impacts on July 27, 2oo6. <br /> 8. The Planning Commission reviewed and discussed the EAW and results of the <br /> meeting with the Department of Transportation at the regularly scheduled <br /> meeting on August 17, 2oo6 and determined that the proposed projected did not <br /> have the potential for significant environmental effects and found that an EIS is <br /> not required based upon the following findings of fact: <br /> a. Type,Extent,and Reversibility of Effects <br /> i. The City of Pequot Lakes Land Use Ordinance permits and <br /> supports the use of this type on this site for the recreational <br /> vehicle park. <br /> b. Cumulative Potential Effects of Related or Anticipated Future <br /> Projects <br /> i. There are no anticipated future projects in the area,which is zoned <br /> for low-density development. <br /> c. The Extent to which the Environmental Effects are Subject to <br /> Mitigation by Ongoing Public Regulatory Authority <br /> i. The City of Pequot Lakes Planning has review of permits required <br /> by the City related to this project, with the City of Pequot Lakes <br /> having final review authority over these permits.
