Planning Commission Report,August 2006 10
THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDS THAT THE
REQUEST TO REZONE TO COMMERCIAL BE DENIED BASED ON THE
FOLLOWING FINDINGS OF FACT:
1. The rezoning to Commercial is not consistent with the City's Comprehensive Plan and
Future Land Use Map, which designates this area as a forest preservation area. At the
time the Future Land Use Map was created, this parcel was a part of the surrounding
properties, which were owned by a forestry company and were more than 50% wooded
as a whole.
2. The parcel is bordered to the south by property zoned Agriculture and is otherwise
entirely surrounded by properties zoned Forest Management.
3. Rezoning the property to Commercial would constitute spot zoning as there are not any
other properties in the immediate vicinity of that, or a similar, zoning classification, and
opportunities would be made available to this particular landowner that are not present
on the adjoining properties.
4. The property does not meet the compatibility requirements for the Commercial zone,
which cannot be established in an area where it is completely surrounded by residential
zones.
5. The area of the property, 20 acres, meets the minimum lot area for both the Commercial
and Forest Management zones.
6. Rezoning to Commercial would be inconsistent with the immediate surrounding land
uses,which are of a low density,rural character.
7. The topographic characteristics of the property are best suited to a Forestry zoning
classification. The topography would not be suited to commercial development.
8. The Comprehensive Plan identifies a need to preserve a wooded corridor in to and out of
the downtown area. This is incompatible with a Commercial zoning classification.
7. HEARING: Preliminary Plat of Buschmann Addition. Housing and
Redevelopment Authority,applicant.
The proposed Buschmann Addition is a development within the preexisting Biggs Addition
in the central part of the City, located on Oak Street. The development consists of Lots 21,
22, 23, and 24 and is currently zoned Urban Residential. The subject property totals 28,165
square feet in size. The applicant proposes to take the four existing lots replat the area into
three lots. The proposed subdivision will increase the size of each lot and reduce the total
number of lots from four to three.
THE PLANNING COMMISSION UNANIMOUSLY RECOMMENDS THAT THE
PRELIMINARY PLAT OF BUSCHMANN ADDITION BE APPROVED BASED ON
THE FOLLOWING FINDINGS OF FACT:
1. All three proposed lots meet the minimum buildable lot size of 6,250 square feet for the
Urban Residential zone, each having over 9,200 square feet of area. The land is able to
be built upon with minimum alteration required.
2. The property currently contains a dwelling and two sheds. The existing house would fall
on the lot line between the proposed Lots 1 and 2 and would need to be removed. The
larger shed is currently located on the western portion of the proposed Lot 1 and extends
somewhat into the adjacent right-of-way.This structure would also need to be removed
or relocated.
3. All three proposed lots have access to municipal sewer.
14084 Baxter Drive, Suite 7 1 Baxter, Minnesota 56425 1 218.828.3064 1 www.communitygrowth.com
