Motion carried. <br /> APPLICANT: Robert and Penny Ritter <br /> Applicants request a Variance to Exceed Maximum Cumulative Accessory <br /> Structure Size. <br /> Tom Adams recused himself as he is a personal friend of the applicants. Mr. Marohn <br /> explained the Staff Report. Applicants were present. Mr. Ritter stated that they own 3.9 <br /> acres,not the 2 plus as stated in his application. <br /> Kendall Meyer, 27845 County Road 107, stated he is the immediate neighbor to the <br /> north. They agree on allowing the variance. He questioned why the 1,280 sq. ft. <br /> maximum applied to any size lot. Mr. Marohn explained why 1,280 sq. ft. is used and <br /> what other zones allow. Mr. Meyer stated there is no flexibility allowed in the Shoreline <br /> Residential zone. There are other lots in the City that are deep and this request will come <br /> up again. The Planning Commission stated that we need a sliding scale or we will <br /> discourage residents from storing items under cover. Mr. Hallan stated that there are <br /> buildings of similar size nearby. Mr. Marohn stated the building could be an over-the- <br /> counter permit if the other accessory structures were removed. The Planning <br /> Commission discussed possible amendment of the Ordinance. <br /> A motion was made by John Derksen, seconded by Bill Habein, to approve the variance <br /> for structure size and location applied for, subject to the following finding of fact: <br /> 1. It is the intent to revise the maximum square footage with increased acreage and <br /> large setbacks from the OHW. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests Ordinance Amendment for Impervious Coverage in the <br /> Transition Residential Zone for Rural Conservation Subdivision (RCS) <br /> Developments. <br /> Mr. Marohn explained the Staff Report. <br /> A motion was made by Tom Adams, seconded by Scott Pederson,to recommend Section <br /> 8.1, subdivision 3C of the Land Use and Subdivision Ordinance be amended to read: <br /> C. Maximum Coverage by Structures. Same as the underlying district as applied <br /> to the entire parcel prior to subdivision, except in the Transition Residential <br /> zone where impervious coverage may be increased to 30% of the total lot area <br /> provided that the following conditions are met: <br /> i. The property containing the proposed subdivision lies outside of <br /> shoreland areas(1000 feet of a protected water). <br /> H.
