APPLICANT: City of Pequot Lakes <br /> Applicant requests to rezone from Forestry to Forest Management. Parcel No. <br /> 290134100A0009. Louann Owens, property owner. <br /> Mr. Marohn explained the Staff Report. Applicant was present and stated she requests <br /> the property be rezoned to Rural Residential due to the development around it in Breezy <br /> Point. Jerry Zwack, friend of applicant, stated they have owned the property for 25 years <br /> and the township line runs through their property. They own 20 acres in the City of <br /> Pequot Lakes and 70 acres in Breezy Point. There are 3 developments in close proximity <br /> in Breezy Point and they have always planned to develop at some point. <br /> Mr. Marohn stated the City cannot zone for development that might happen in the future. <br /> Mr. Zwack stated that the Saxvold's had requested and received Rural Residential <br /> zoning. Mr. Marohn stated that the Saxvold's property was on Akerson Road and there <br /> was other Rural Residential property in the immediate vicinity. This parcel has no <br /> accessibility to public right-of-way. Applicant would need to go through the platting <br /> process. This parcel could be divided into 2 parcels now as Forest Management. <br /> A motion was made by John Derksen, seconded by Mark Hallan,to recommend rezoning <br /> this parcel to Forest Management,based on the following findings of fact: <br /> 1. The proposed rezoning to Forest Management would be consistent with the City's <br /> Comprehensive Plan which states as policies to protect and enhance natural <br /> resources and open space along with to direct future development away from <br /> significant and/or sensitive natural resources (page 56). The subject property is <br /> located adjacent to Lowell Wildlife Management Area, managed by the <br /> Department of Natural Resources. <br /> 2. The proposed rezoning to Forest Management is consistent with the Future Land <br /> Use Map, which designates this area as a future Forest Preservation area. <br /> 3. The property currently is undeveloped, and is covered with forest stands and <br /> wetlands. <br /> 4. The proposed rezoning to Forest Management meets the compatibility <br /> requirements for the zone as the surrounding parcels are zoned Forest <br /> Management or Recreation. <br /> 5. The subject property meets the purpose and intent of the Forest Management zone <br /> as would protect the natural environment, preserve an undeveloped area, and <br /> enhance any recreational opportunities available in the adjacent Wildlife <br /> Management Area. <br /> 6. The property meets the minimum lot size requirement of 10 acres for the Forest <br /> Management zone,being more than 22 acres in size. <br /> 7. The property meets the minimum lot width standard of 300 feet for the Forest <br /> Management zone, being over 1000 feet wide on the east and south sides of the <br /> lot, despite its irregular shape. <br /> 8. Rezoning to Forest Management would not constitute a down-zoning as the lot <br /> size and dimension standards for the proposed zone are the same as the previous <br /> zoning classification. <br /> Planning Commission Meeting 3 <br /> July 20,2006 <br />
