City Ordinance <br /> (a) With respect to intoxicating liquor, there shall be six types of licenses: on sale, on <br /> sale club, on sale wine, Sunday on sale, temporary on sale, and off sale. On sale licenses <br /> shall permit the licensee to sell intoxicating liquor at retail for consumption on the <br /> licensed premises only. Except as provided herein, off sale licenses shall permit the <br /> licensee to sell intoxicating liquor at retail in original packages for consumption off the <br /> licensed premises only. The number of on sale intoxicating liquor licenses shall be <br /> limited to four(4)pursuant to Minnesota Statute Section 340A.413, restaurants, as <br /> defined herein, holding on sale liquor licenses shall not be included in this limit. The <br /> number of off sale licenses shall be limited to two. <br /> State Statute — 340A.413, ubd. 5 <br /> Subd. 5. Off-sale licenses. No off-sale intoxicating liquor license may be issued in any <br /> city, except as provided in this section, in excess of the following limits: <br /> (1) in cities of the first class, not more than one off-sale license for each 5,000 <br /> population; and <br /> (2) in all other cities the limit shall be determined by the zoverninz body of the city. <br /> Council Action Requested: Council decision whether to <br /> increase the number of licenses, and if so, to how many. If <br /> the Council wants to increase the number of off-sale <br /> licenses, staff will prepare an ordinance amendment for <br /> Council consideration at the next Council meeting. <br />
