Planning Commission Direction: The Planning Commission can recommend approval of <br /> the conditional use permit, recommend denial, or table the request if additional information is <br /> needed. If the recommendation is for approval or denial,findings of fact should be cited. <br /> Staff Recommendation: Everyone involved with the City has been supportive of this <br /> development through the concept phases. While the actual details are always more difficult <br /> than the concept, this remains a viable project with a good likelihood of success. It is not, <br /> however,ready to be acted upon at this time,and we recommend that it be tabled. <br /> There are a number of issues that must be addressed during the Conditional Use Process to <br /> ensure that the project is viable and ready to go on to the next phase. At this point, those <br /> include the following: <br /> - Screening and vegetation enhancement issues, specifically as it relates to buffer <br /> zones between adjacent properties and Hurtig Road. <br /> - The status and condition of Hurtig road and how improvements induced by this <br /> development are going to be paid for. <br /> - What improvements to Highway 371, if any, are going to be necessary immediately <br /> and as part of the highway expansion and how those improvements are going to be <br /> paid for. <br /> - Whether or not there is need to further evaluate the Blandings turtle impacts/issues. <br /> - A preliminary water system design and analysis so that there is an understanding of <br /> the system and technology that is going to be utilized and the extent of the <br /> investment required. <br /> - A preliminary wastewater system design so that there is an understanding of the <br /> system and technology that is going to be utilized and the extent of the investment <br /> required. <br /> - A preliminary evaluation of drainage patterns and runoff impacts so that there is a <br /> reasonable degree of confidence that stormwater is going to be handled on site and <br /> not allowed to negatively impacts adjacent properties, internal RV sites or wetland <br /> areas. <br /> - A preliminary grading plan that demonstrates how topographical issues in Block 2 <br /> are going to be dealt with as well as how grading issues around sites 16 through 19, <br /> 29 and 30 in Block 1 will be addressed. <br /> - A rudimentary plan for how solid waste is to be handled on site. <br /> - A draft of covenants or deed restrictions to demonstrate that the applicant has <br /> thoroughly thought-out the process of ensuring that the resort remains a viable <br /> operational entity in perpetuity. <br /> - An indication of the amount and proposed location of signage anticipated with the <br /> development. <br /> - Documentation of the composition of a typical site. <br /> - Completion of the Environmental Assessment Worksheet. <br /> There are a number of issues that can be addressed between the Conditional Use Permit <br /> approval and the Final Plat. These are items where the overall issue would not be in question, <br /> but there are some technical details to work out. Once the issues in the above list are resolved, <br /> items that could be made conditions of a CUP approval would include: <br /> - Attaining Department of Health certification for the project. <br /> - Providing a final water system design and analysis. <br /> - Providing a final sewage treatment system design. <br /> - Completing sewage treatment system permitting with the MPCA. <br /> - Providing a formal solid waste disposal plan. <br /> - Providing a final drainage plans showing containment of the required rain events. <br /> - Providing a final grading and erosion control plan. <br /> City of Pequot Ickes Staff Report 5-9 <br /> March 16,2006 <br />
