4. Does the City Engineer agree that all improvements required are satisfactorily completed <br /> or are guaranteed by contract with adequate financial security? <br /> 5. Does an independent Professional Land Surveyor agree that the final document meets <br /> the statutory requirements? <br /> 6. Has financial security been posted in the appropriate amount? <br /> Staff Findings: The Staff provides the following findings of fact for consideration by the <br /> Planning Commission: <br /> 1. The applicant has complied with the one condition placed on approval of the preliminary <br /> plat,that Lots 2 and 3,Block One do not have direct access off of CSAH 17. <br /> 2. The Final Plat agrees with the Preliminary Plat. The design has not changed since <br /> preliminary plat approval. <br /> 3. The City Attorney has reviewed the plat and the development contract. <br /> 4. The City Engineer has been working with the applicant to review the proposed <br /> improvements and develop a development contract. <br /> 5. The applicant has submitted a plat check by an independent Professional Land Surveyor. <br /> 6. At the time of this report's preparation, the applicant was in the process of obtaining a <br /> cost estimate to be inserted into the final development agreement and to be approved by <br /> the City Engineer. <br /> Planning Commission Direction: The Planning Commission should develop findings to <br /> either approve or deny the final plat. In general,the Commission cannot deny a final plat unless <br /> the applicant will not or cannot meet the final platting requirements or the conditions of the <br /> preliminary plat approval.The Commission cannot impose additional conditions that do not fall <br /> directly within the guidelines of the final plat or relate directly to conditions imposed in the <br /> preliminary plat. <br /> The Commission also has the option to table the final plat to obtain additional information. <br /> Staff Recommendation: Based on the findings of fact presented in this report, the Staff <br /> recommends tabling the application at this time so that the applicant can submit the remaining <br /> required items. If Mr. Berens has been able to obtain a cost estimate for the proposed <br /> improvements, and the City Engineer has reviewed and approved those, the Staff would <br /> recommend that this application be approved. <br /> In addition, it should be noted that the Park Board is recommending that the applicant pay the <br /> park dedication fee, equal to io% of the property's value prior to the plat. The total estimated <br /> market value of the land prior to platting is$32,100,so the park dedication fee would be$3,210. <br /> This cost has been included in the development agreement. <br /> City of Pequot Lakes Staff Report 4-2 <br /> April 20,2006 <br />
