STAFF REPORT <br /> Application: Final Plat of the Keen Addition <br /> Applicant: Al Berens <br /> Background: The property measures approximately 6.8o acres in size is currently zoned <br /> Transition Residential. The applicant submitted the preliminary plat application prior to the <br /> adoption of the new Land Use and Subdivision Ordinance, and so falls under the lot size and <br /> dimension standards of the previous Ordinance, under which the zoning classification was <br /> Medium Density Residential. The Keen Addition would create six residential lots measuring <br /> 41,438 square feet in size and a new road to be named Josh Court. The final plat is the last step <br /> in the subdivision process. <br /> 'W.0 r + i County:H- -7, <br /> Keen Addition ,t <br /> I <br /> d <br /> µ' <br /> r- <br /> I . <br /> if <br /> Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must also meet any conditions imposed by the <br /> City during the preliminary plat approval. The applicant received approval of the preliminary <br /> plat, with six lot measuring 41,438 square feet in size, in August, subject to the following <br /> condition: <br /> 1. Lots 2 and 3,Block 1,will not have direct access to CSAH 17. <br /> Section 11.9, Subdivision 6C outlines the procedure to follow when reviewing a final plat <br /> application and directs the Planning Commission to consider the following: <br /> 1. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned wither through performance or execution <br /> of appropriate agreements assuring performance? <br /> 2. Does the Final Plat or Final Condominium Plat agree with the Preliminary Plat or <br /> Preliminary Condominium Plat? <br /> 3.
