Crow Wing County Zoning Ordinance <br /> Part IIIāDevelopment Standards <br /> iv. At least one boring shall be required per inspection. <br /> 37.11 TRANSFER OF PROPERTY <br /> The Sale or Transfer of Property on which a dwelling is located,or a tract of land on which a <br /> structure is located,or a tract of land on which a structure is required to have an ISTS shall not be <br /> transferred unless the parties to the transaction have complied with the following. <br /> A. Certificate of Compliance,completed by a qualified employee,ISTS licensed inspector or a <br /> Designer 1,shall be provided by the seller to the buyer,and the Zoning Officer,at or before <br /> the closing date. <br /> B. In the event the seller does not provide a certificate of compliance,the seller and buyer may <br /> establish a written agreement or contract to repair,replace or upgrade the existing septic <br /> system according to the terms of this Ordinance and Minnesota Rules Chapter 7080.After a <br /> complying ISTS has been installed a certificate of installation shall be issued. <br /> C. The buyer may accept total responsibility of the existing ISTS and be responsible for the <br /> necessary upgrading. <br /> 37.12 ISTS COMPLIANCE INSPECTION AGREEMENT <br /> A. Must be used anytime between freeze-up in the fall until the ground thaws in the spring, <br /> generally accepted as November 1 through April 30. <br /> B. Compliance inspections must be performed by June 1. <br /> C. Any systems that are found to be"failing"shall be brought into compliance during the <br /> current construction season. <br /> D. Any systems that are found to be an imminent health threat must be eliminated within seven <br /> (7)days of the date of notification,and the entire system brought into compliance during the <br /> current construction season. <br /> 37.13 ADDITIONAL SOIL TREATMENT AREA REQUIREMENTS <br /> All new lots or parcels created after January 23, 1996 shall have a minimum of one(1)additional <br /> soil treatment area which can support a standard soil treatment system. <br /> 37.14 PERMIT REQUIREMENTS <br /> A Permit from Crow Wing County Planning and Zoning is required whenever any septic system <br /> is installed,altered,replaced,or extended. <br /> A. Application Requirements. All applications shall include the following: <br /> i. Name and address of the property owner. <br /> ii. Real Estate code for the property and complete legal description. <br /> iii. Designer name,address,phone number and license number. <br /> iv. Site evaluation report,drawn to scale to fit an 8.5 x 11 inch page including all proposed <br /> and existing structures and underground utilities. <br /> v. System design,including all proposed construction and any applicable information. <br /> A The application must be on a Crow Wing County Site Design Form. <br /> Vii. Well locations and depths potentially affected by the design shall be indicated by the <br /> Designer conducting the work. <br /> Viii. Signature of the Designer. <br /> is. Permit Review.The site evaluation and design and exhibits must be presented to the <br /> Crow Wing County Planning and Zoning office for review and approval prior to issuing a <br /> construction and/or sewer permit.The permit review period shall be up to 10 working <br /> days.When approved,construction can begin and shall be completed within two years of <br /> the permit date on new construction. However,the ten(10)month language applies for <br /> Part III Page 63 <br />
