C. Certificate of Installation: A Certificate of Installation shall be issued by the County within 30 days of inspection of all newly constructed septic systems. 37.9 LICENSING REQUIREMENTS A. Inspectors,Designers,Installers, and Pumpers shall meet the following licensing requirements. B. MPCA license required. No person shall engage in the evaluation,inspection,design, installation,construction,alteration,extension,repair,maintenance,or pumping of onsite sewage treatment systems without first obtaining a license to perform such tasks from the Minnesota Pollution Control Agency. Any party conducting compliance inspections at point of sale or for other legal purposes shall be licensed by the Minnesota Pollution Control Agency. C. License exception: An MPCA license is not required of an individual who is constructing a septic system on land that is owned or leased by the individual and functions solely as a dwelling for that individual.Installation of the system shall be based upon a design by a licensed designer. The system shall be inspected before it is covered and a twenty-four(24) hour notification for inspection is required. 37.10 COMPLIANCE INSPECTIONS A. Compliance Inspection Requirements for Existing Systems: Only a qualified employee or authorized licensee or licensed Designer or Inspector independent of the owner shall complete an inspection when a compliance inspection is required for an existing septic system. A copy of the Certificate of Compliance or Notice of Noncompliance resulting from a compliance inspection shall be provided to the property owner and the County within 30 `.. working days of the inspection. A licensed inspector who inspects an existing system may subsequently design and/or install a new system for that property,provided the inspector is licensed to install individual sewage treatment systems. The licensed professional may not inspect the installation of a new system if he/she is the designer or installer. B.Disputed Compliance Inspections:All responsibility for resolving disputed compliance inspections is placed upon the property owner.This may include,but not limited to, additional compliance inspections,hiring a Minnesota registered professional soil scientist who is also a licensed ISTS designer,all legal costs,and time limit for resolution. C.Mandatory Compliance Inspections of Existing Systems. An existing septic system shall require a compliance inspection when any one of the following conditions is met. i. When applying for a Zoning Permit and the Certificate of Installation is more than five years old or the Certificate of Compliance is more than three years old. ii. Within ninety(90)days of a Certificate of Real Estate Value of Warranty Deed or Trust being filed with a property dependent on an on-site septic system and the Certificate of Installation is more than five years old or the Certificate of Compliance is more than three (3)years old. iii. Any time the Planning and Zoning Department deems appropriate. iv. Any addition to a residence or accessory structure on the property,or variance to an existing septic system. v. Any necessary disclosures. D. Compliance Inspection Requirements i. Must be completed per MPCA 7080 rules,using a current MPCA compliance inspection form. ii. Must include a complete site sketch drawn to scale showing locations of buildings served by the septic system,all well setbacks,and locations of septic components. iii. No graph paper is allowed.
