There <br /> �— was agreement at that time that the restoration work had not been adequate. <br /> There was discussion on this at the August 21, 2008 Planning Commission meeting, where Chad <br /> Conner indicated that a landscape architect was developing a plan for restoration. Your final plat <br /> was approved with an understanding that that was to be completed in short order. <br /> As of October, the restoration is still incomplete. No substantive work has been done to resolve <br /> this matter since last June. There is no plan or indication that you intend to do anything to <br /> address this issue. <br /> Construction without a permit. <br /> It has recently come to our attention that you have constructed a cabin without a permit. Even <br /> more seriously, the construction proceeded following the Cease and Desist Order and after <br /> Pequot Lakes staff informed you, in writing on December 6, 2007, that construction could not <br /> proceed. <br /> Prior and potentially ongoing clearing of vegetation within the shore impact zone <br /> Your Conditional Use Permit submittals indicated that nearly all vegetation within the Shore <br /> Impact Zone would be preserved. This was also a requirement of the development, as found <br /> within condition 6, which says the following: <br /> "The developer shall submit an updated vegetation enhancement plan. The plan <br /> `. shall detail preservation areas (natural areas) and the mechanism for <br /> preservation. At a minimum, the plan shall: <br /> i. Restore and preserve all areas within the shore impact zone outside of <br /> the beach and picnic area, except for 8-foot walkways to the docking <br /> areas." <br /> You are required to maintain compliance with the approved plan, which prohibits removal of the <br /> vegetation from within the Shore Impact Zone, except in a couple of designated areas. <br /> Concerned citizens have presented the City with before and after photographs of the property in <br /> the areas adjacent to the recent construction. We have included them with this mailing. It is <br /> quite evident that extensive vegetation clearing has taken place in violation of your Conditional <br /> Use Permit. <br /> Completion of Permit Conditions <br /> Your Conditional Use Permit was approved, after much discussion and negotiation, with twenty <br /> conditions that were mutually agreed to. Some of those conditions remain incomplete. We have <br /> highlighted those in RED and BOLD type in the following. <br /> Conditions: <br /> 1. All previous Conditional Use Permits on this property are superseded by this permit. All <br /> previous CUP's are null and void. <br /> 2. Prior to submission of a final plat application,the following shall occur: <br /> a.
