The Planning Commission has <br /> directed me to contact you and accept your invitation to appear at their next meeting, which is <br /> November 20, 2008. The meeting is at City Hall and begins at 6:30 PM. <br /> The Planning Commission has also declined to lift the cease and desist order on your property. <br /> As such, Staff will not be accepting any additional permit applications from you until the <br /> outstanding issues have been resolved. I am also informing you that further violation, or failure <br /> to resolve the existing violations in a timely manner, could lead the City to declare you in default <br /> `. of your Conditional Use Permit. If that were done, the resort would need to be closed until the <br /> issues were resolved and a new permit would need to be applied for. <br /> This is a very serious matter. <br /> The Planning Commission is going to want to discuss at least four issues with you. Those <br /> include: <br /> 1. Restoration of the beach areas. <br /> 2. Construction without a permit. <br /> 3. Prior and potentially ongoing clearing of vegetation within the shore impact zone. <br /> 4. Completion of permit conditions. <br /> Restoration of the beach areas. <br /> On November 19, 2007, the City of Pequot Lakes issued a cease and desist order for construction <br /> that was ongoing within the shore impact zone. We met out at the property shortly thereafter and <br /> you reached an agreement with City representatives to restore the disturbed areas. You were to <br /> have applied for a permit by May 1, 2008 and finish the restoration work by June 1, 2008. <br /> You applied for and received a permit for the restoration work on May 27, 2008. This was <br /> nearly a month after the deadline you had agreed to. Chad Conner of WSN, acting on your <br /> behalf, then requested and received an extension from June 1 to June 4 for the restoration <br /> component. <br /> A site visit was done by Pequot Lakes Staff in June. It was documented that the work that had <br /> been performed did not effectively restore the site and was inadequate.
