A motion was made by John Derksen, seconded by Roger Varilek, to recommend
rezoning this parcel to Agriculture and to authorize Staff to withdraw recommendation if
notified by property owner, based on the following Findings of Fact:
1. The rezoning to Rural Residential is consistent with the City's Comprehensive
Plan and Future Land Use Map, which designates this property as a Rural
Residential.
2. The rezoning to Agriculture would not be consistent with the City's Future Land
Use Map, although the area to the west of this property is designated as future
Agriculture area on the Map.
3. The rezoning to Rural Residential would not meet the compatibility requirements
for the Rural Residential zone, which indicates that the zone may not be
completely surrounded by Forest Management and Agriculture zones.
4. The property does not meet the minimum lot size of 5 acres for the Rural
Residential zone, as it is just under 2 acres in size.
5. The current property owner has a purchase agreement in place with the owner of
the property surrounding the subject property.
6. The adjoining property is zoned Agriculture, and the future property owner has
indicated that he would like to have the subject property zoned likewise.
7. The subject property, on its own, does not meet the minimum lot size of 20 acres
for the Agriculture zone, being just under 2 acres in size. The purchase agreement
in place would combine the subject property with the adjoining, surrounding
property, which in total does meet the minimum lot size and dimension
requirements for the Agriculture zone.
8. While the City has sought to avoid downzoning properties, in this case, the future
property owner has requested to be rezoned to Agriculture.
All members voted"aye". Motion carried.
APPLICANT: City of Pequot Lakes
Applicant requests to rezone from Residential to Shoreline Residential. John and
Rebecca Hurst,property owners,Parcel No.: 291230000110009. Roger Prigge,
property owner,Parcel No.: 291230000120009.
The property owners were not present. Mr. Marohn explained the Staff Report. There
was no public comment.
A motion was made by Tom Adams, seconded by John Derksen,to recommend rezoning
these parcels to Shoreline Residential, based on the following Findings of Fact:
1. The rezoning to Shoreline Residential is consistent with the City's
Comprehensive Plan as the properties are adjacent to shoreline and are residential
in character.
Planning Commission Minutes 8
December 14, 2006
