Polly Abler, Crosslake, stated Curves would bring business to town. Patrons workout so <br /> they are able to eat more, bringing business to local eating establishments, as well as <br /> shopping. <br /> Parking in the City Hall lot was discussed. Employees could park at the City parking lot. <br /> It would be a beneficial solution for both businesses. <br /> Dave Sjoblad, City Councilman, stated that the highway business is out to year 2014. <br /> County Road 11 is a County Road and the City cannot dictate parking. The City <br /> employees have been asked to park on the east side of the City Hall parking lot to leave <br /> easy access for people visiting City Hall. <br /> A motion was made by Tom Adams, seconded by Bill Habein,to approve the <br /> Conditional Use Permit,with no conditions, based on the following Finding of Fact: <br /> 1. The establishment of a fitness center (Curves) is an appropriate use in the <br /> Downtown Mixed Use district. A fitness center qualifies as Commercial Use, <br /> Other, which requires a conditional use permit in the DMU district. <br /> 2. The proposed use of a fitness center does not conflict with the Comprehensive <br /> Plan, which indicates the importance of the service sector of the business <br /> community. <br /> 3. The proposed use is compatible with the existing neighborhood, which contains <br /> other existing commercial establishments, such as a hair salon. <br /> 4. The establishment of a fitness center (Curves) is not injurious to the use and <br /> `., enjoyment of other property in the immediate vicinity, nor does it substantially <br /> diminish or impair values in the immediate vicinity. The fitness center will be <br /> located in an existing building; no new construction is needed. <br /> 5. The proposed fitness center is unlikely to be injurious to the use and enjoyment of <br /> other property in the immediate vicinity for the purpose permitted on the property, <br /> nor will a fitness center substantially diminish or impair values in the immediate <br /> vicinity. The activities of the proposed use will be contained within the existing <br /> building. <br /> 6. The fitness center will not impede normal and orderly development because the <br /> fitness center will be established in an existing commercial building. <br /> 7. The establishment of a fitness center will not have a detrimental impact on public <br /> costs for public facilities and services and will not be detrimental to the economic <br /> welfare of the community. The building is served by an existing on-site septic <br /> system and no additional utilities or public facilities are needed at this time. <br /> 8. The proposed use is unlikely to create an interference with traffic in the <br /> immediate vicinity. The building, parking area, and access to the property <br /> currently exist, and the proposed use is unlikely to generate excessive amounts of <br /> traffic for the infrastructure in place. <br /> 9. There are adequate measures to provide sufficient off-street parking and loading <br /> space. There is an existing gravel parking lot that can hold approximately 5 <br /> vehicles. Also, the parcel is located within the Downtown Mixed use District, and <br /> it exempt from parking standards outlined in Section 7.10. <br /> 10.
