To check this <br /> one off, do we just pay permit cost or establish an After the Fact fee? <br /> Issue#2: Construction without a permit—A motion was made by Mark Hallan, <br /> seconded by Bill Habein, to have Staff issue the permit for Unit 21 with an After the <br /> Fact fee of 2 times the original permit fee. A mistake was made and some type of <br /> attention getter is necessary, but not totally malicious because they have to build 40 <br /> more units and to make sure this doesn't happen again. All members voted"aye". <br /> Motion carried. <br /> Issue#1: Restoration of the beach areas: Some work has been done but progress has <br /> been agonizingly slow. Overall vegetation plan not presented yet. Grasses were <br /> planted but not cared for. More needed to be done. It is frustrating to not see <br /> progress move along more quickly. DNR coordination was location of docks only. <br /> There has not been a Cease and Desist issued within the last 40 days. Staff would not <br /> issue permits without concurrence of the Planning Commission. There are other <br /> violations on the property, such as the beach restoration is outstanding and not <br /> resolved, and clearing in the SIZ has not formally been documented. The Planning <br /> Commission can issue the permit, not Staff. Mr. Steffens stated he would need some <br /> building permits for construction over the winter. <br /> The Planning Commission stated we could require a bond, such as with contractors or <br /> developers, for the replacement of the beach area. Mr. Steffens stated he would like a <br /> chance to do the restoration before hiring someone like Landsburg. <br /> Mr. Steffens has hired a Landscape Architect. The Landscape Plan will be brought to <br /> the Planning Commission in January. Mr. Steffens needs permits prior to January. <br /> The cost of restoration needs to be determined. The City should require 125% of the <br /> actual restoration cost in either a bond or a certified check. Mr. Steffens will obtain <br /> the actual cost and supply the City with either a bond or a cashiers check for 125% of <br /> the actual estimated cost. The City can issue up to 2 permits prior to January. <br /> Beach restoration: Biodegradable fabric log secured with wood stakes; riparian <br /> meadow forbs and sedges, sow seed mix in 1 inch depth of topsoil, secure with <br /> erosion control fabric,keep moist for duration of first growing season. <br /> A motion was made by Dean Williams, seconded by Mark Hallan, to restore the <br /> beach area as described above, submit a bond or cashiers check for 125% of <br /> estimated cost, and plan must be received prior to Thanksgiving (November 27, <br /> 2008). After submittal of bond or cashiers check, permits can be obtained. All <br /> members voted"aye".
