#3. Clearing of vegetation within the SIZ: Photos have been provided and are
north of the beach area, east side of the resort. Mr. Miller stated that the"before and
after"pictures are not of the same locations. They are protecting the Shore Impact
area and have not done any disturbance in those areas. Nothing has been done on any
of the rest of the resort, only areas of construction. The former resort owner had
numerous boats docked in this area. For the next meeting, the Planning Commission
has asked to have the SIZ staked so they, as individuals, can take a look at these
areas.
#4. Completion of permit conditions: These will be discussed in order as outlined
in Mr. Marohn's letter of November 6, 2008:
#3: Site Inspections by City Staff of Erosion Control Devices: No inspections by
Staff have been done. Soil and Water have been out there several times. Mr. Miller
thought they gave reports to City. City must be notified whenever erosion control
devices are placed. Devices must be placed anytime there is construction or
whenever a permit is pulled.
#6.C: Vegetation Plan: The Vegetation Plan has not been received. It may head off
some of the concerns by neighbors, etc. Without the plan it is hard for Staff to tell if
what they are doing is right or wrong. The sooner we get the plan, the sooner we can
head off some of the concern. The Plan is to be submitted at the January meeting.
Mr. Hallan stated that when the storage units are constructed and the septic system is
`.. installed, hundreds of trees are going to come down. Be sure to include clearing and
grubbing necessary to do this.
#11: Placement of Docks: DNR must approve and will be part of plan in January.
Mr. Miller stated they have a meeting scheduled with them and will have written
comments from that meeting in January.
#12: Road in Bluff and Shoreline Setback: The road has not been removed. It is a 2
rut trail. They will incorporate that in with the trail so there will be no new
construction in this area. An emergency vehicle needs to have the trail 10 feet wide.
The First Responders have a 4-wheeler that pulls a dog sled type sled on wheels, not
requiring the 10-foot trail.
#17 & 18: Beach Construction and Grading on Westerly Shoreline: The dates were
missed. They were approved with the amended CUP. The sand that was added to the
westerly shoreline will remain. Whether they need a CUP will depend on the volume
of the grading.
Rezoning of common space has been taken care of. Staff was directed to develop
report of outstanding conditions.
Mr. Miller stated that the Wilderness Resort Villas documents were filed with the
original plat. To make changes was rather simple, a series of documents needed to be
MINUTES 10
Pequot Lakes Planning Commission
November 20, 2008
