The Whitefish Property Owners Association earlier had an article in the local newspaper
-- regarding support to oppose the Corps of Engineers regarding an early drawdown of the
Whitefish Chain. Commission Member Derksen had requested this be included on the
Agenda of the October meeting and there is no evidence of this being discussed in the
October Minutes. An early drawdown could have an impact on boating in a drought
year; it shouldn't have an effect in a wet year. The Corps has a contingency plan for not
drawing down for drought years. Staff was directed to put this on an upcoming Agenda
if this is something we need to act on in the future.
In the McDermott public hearing, Staff was directed to remove the second sentence in
paragraph 3.
A motion was made by Mark Hallan, seconded by Bill Hallan,to approve the October
Minutes as corrected. All members voted"aye". Motion carried.
ZONING ADMINISTRATOR'S REPORT:
Staff pointed out the 7 permits issued and the 13 letters written or received.
1. Dump—The Planning Commission stated the Dump Clean Up should have made
front page of the Echo.
2. Derouchie—Garbage has been removed by the City.
3. McDermott—No timeline for construction and no permit application received.
4. Dan Helbling's letter—Annual review committee still meets and there has been
no response from Mr. Helbling. This tree removal is not being monitored. We
reviewed submittals and they did meet the ordinance. The Plan is filed with the
City and that is all that is required. Who enforces the CUP? Staff directed to
include CUP information in future monthly hearings.
The following Potential Violations/Enforcement Actions were discussed.
1. Tom Steffens, Wilderness Resort Villas, LLC—
Mr. Steffens and Jeff Miller were in attendance. Last month Mr. Steffens stated in a
letter he would like to attend this meeting to discuss the Wilderness Resort property.
There is frustration over beach area, construction of building, clearing in SIZ and
completion of CUP conditions.
Jeff Miller, WSN, stated he would address each of the points in the letter from Chuck
Marohn to establish a resolution to each of the items. The beach was constructed
from a plan not revised after the City Council changed the Planning Commission
decision. They admitted the error and commenced removal of area of beach.
Attached to that permit was list of items they were going to do. Permit was issued on
May 27 and it says to restore non permitted beach area as listed on the email from
MINUTES 7
Pequot Lakes Planning Commission
November 20, 2008
