Scott and Julie Smith:
Mr. and Mrs. Smith would like to know what they can do with their lot. They would like
to trim the trees and put up a billboard sign to sell skidloaders. If the road is going to
reroute,they will sell the lot.
Their CUP was denied at the March meeting. The application was to put up a building
and signs. The app was denied as the storage structure is not a principle use. A principle
use must first be established before any signage. Principle Use is an ongoing business on
the site. Conduct commerce on the site and have employees. Not just storage or a sign.
Mr. Smith asked if one day a week with a small fenced area with 3 skidloaders would be
sufficient. A car lot, where you have people working onsite and others stop there and
look at the skidloaders and make a transaction, that is a principle use. If there is a vacant
building with a sign where you call to purchase a skidloader is the opposite.
Mr. Smith asked if a storage shed operation would be allowed. He was told he would
need a principle use first. The Planning Commission explained that the City is trying to
entice business into the area. Ordinance specifies no storage units.
The Planning Commission explained the City encourage the types of businesses that
create jobs. Billboards are not allowed in the City and most of the County, only in
unorganized territory meeting certain criteria.
The Planning Commission advised Mr. Smith he would need a 400 sq, ft. bldg with a
sales person. Mr. Smith asked about clearing the lot for sale. The Planning Commission
advised he would be able to prep a building site and prepare a building site. He would
need to maintain the trees between the building site and the road. The Funeral Home has
cleared their brush and he could do the same. From the City's stand point, he could put
in a driveway and do some clearing, but he would have to talk to the MPCA because he
would probably do more than 1 acre of clearing. Staff was directed to give them the
telephone number for the MPCA office in Brainerd.
Chairman Woog reopened the public hearing.
APPLICANT: City of Pequot Lakes
Applicant requests an Ordinance Amendment requiring a Conservation Subdivision
Design Ordinance.
Mr. Marohn explained the Staff Report. There was no public comment.
A motion was made by Tom Adams, seconded by Mark Hallan, to recommend the
Ordinance amendment. All members voted"aye". Motion carried.
Chairman Woog closed the public hearing.
APPROVAL OF MARCH MINUTES:
Minutes 17
Pequot Lakes Planning Commission
April 17, 2008
