12. Both Tract A and Tract B meet the minimum frontage on public right-of-way <br /> requirement of 33 feet, with the subdivision of Tract C being reserved for ingress <br /> and egress for both Tracts A and B and lands to the west of the subject property. <br /> Tracts A and B would each own an undivided one-half interest in Tract C, <br /> subject to the following conditions: <br /> 1. The owners of Tracts A and B shall submit a common ownership and <br /> maintenance agreement of Tract C to the City. <br /> 2. The gravel driveway on Tract A shall be reduced in such a way so not as to <br /> encroach upon the side yard setback. <br /> All members voted"aye". Motion carried. <br /> b. Frederick Soukup—Subdivision Discussion <br /> Mr. Soukup stated that he would like to subdivide his 16 acre parcel into 2 or 3 lots. He <br /> had met with Pat Trottier at Landecker and Associates who suggested he meet with the <br /> Planning Commission to discuss a potential subdivision. Creating more than 2 lots would <br /> require platting. Mr. Trottier was concerned with buildable lot area. <br /> Mr. Marohn stated that he had seen the sketch from Landecker. Two lots would not be a <br /> problem,but 3 lots would be difficult. There may not be enough buildable area. Mr. <br /> Soukup would need a topographic survey. Two lots do not require to be platted. He <br /> could subdivide into two lots, a 5 and an 11 acre. In three years he could split the 11 acre <br /> parcel,provided there is enough buildable area. He will need to get a topographic survey. <br /> OPEN FORUM: <br /> Jim Byrne—4905 Olson Road. He received 2 permits from the City. The first was to <br /> remove and replace a new roof and frost footings and the second was to enclose deck. <br /> With a rain storm last summer with the roof off, interior walls were damaged and he <br /> replaced the 3 walls without a permit. <br /> Staff received a report that a new house had been constructed. Permits are public <br /> knowledge. Mr. Byrne met with Staff last week. If he had come in and applied for a <br /> permit, he would have received an over the counter permit. Staffs recommendation <br /> would be to apply for a permit and pay the after the fact fee. The other option would be <br /> to explain to the Planning Commission what happened and see what type of <br /> recommendation they give. <br /> The Planning Commission advised Mr. Byrne to apply for a permit and pay the fee for <br /> an over the counter permit for what was constructed,with no after the fact fee. <br /> Minutes 16 <br /> Pequot Lakes Planning Commission <br /> April 17, 2008 <br />
