Applicant was not present. Mr. Marohn <br /> explained that Staff had contacted Mr. Kennedy in writing asking how he wished to <br /> proceed and received no response from Mr. Kennedy. The written comment from James <br /> Neuman was entered into the record. <br /> Mr. Habein stated that Mr. Kennedy had called him that afternoon at 4:30 and stated if <br /> his request was not going to be approved, he would like it tabled. The neighbors have <br /> concerns with the covenants. <br /> A motion was made by Scott Pederson, seconded by Bill Habein,to approve the <br /> Conditional Use Permit for a Home Occupation as the City technically doesn't have <br /> jurisdiction over the covenants presented to us, based on the following Findings of Fact: <br /> 1. All proposed business activities are proposed to be inside buildings. <br /> 2. The use of the property as a residence will remain the primary use. The area <br /> devoted to business operations will be incidental to the structure. <br /> 3. The operation will be entirely within the structure.
