a) The City could permit up to 10 cubic yards of rip rap, a one-time permit. <br /> Any more than 10 cubic yards would require permission of the Planning <br /> Commission. <br /> b) The entire shoreline needs to have an ice ridge form. There is no <br /> vegetation or ice ridge along the shoreline; it is mowed or weed whipped to <br /> the edge of the water. The natural ridges on either side are evident. <br /> Plantings need to be added, as well as trees. <br /> c) Mr. Brown had placed stakes where he thought the OHW was located. The <br /> City Planner does not agree with the stakes indicating the OHW. The <br /> OHW should be marked by a surveyor. That should not be too expensive <br /> as there should be a benchmark nearby on the lake. <br /> d) Mr. Brown stated he will wait until the next summer to do anything. He <br /> will schedule an appointment with Staff ahead of time. <br /> Referencing the August 29, 2013 email again, planting deep-rooted vegetation <br /> would be better for the lake than the placement of rip rap. The City can permit an <br /> access area for your grandchildren. Only 10 cubic yards of material can be <br /> removed, added, or removed. You would not be able to replenish sand if it were <br /> part of that 10 cubic yards if it were to wash away. Only one 10-cubic yard <br /> shoreline alteration is allowed. <br /> 4. Issues — I do not know who Beth Hippert's immediate supervisor is or whether or <br /> not a written report is made to document a site visit. <br /> A Grading Permit would be required from the City of Pequot Lakes, once the <br /> SWCD approved the filling of the wetland. The City would require a Certificate of <br /> Survey and detailed site plan for any alterations or improvements due to the <br /> constraints of this parcel. <br /> The Zoning Administrator may or may not have the final say in what you propose <br /> to do; it would depend upon your request. The Zoning Administrator is not an <br /> elected position; I am appointed by the City Council and report to the Planning <br /> Commission, City Administrator and the City Council. <br /> Section 17-4.4 of the Pequot Lakes City Code states: <br /> Section 17-4.4 NON-CONFORMING STRUCTURES AND USES <br /> 1. Any nonconformity, including the lawful use or occupation of land or <br /> premises existing at the time of the adoption of an official control under this <br /> chapter, may be continued, including through repair, replacement, restoration, <br /> maintenance, or improvement, but not including expansion, unless: <br /> A. the nonconformity or occupancy is discontinued for a period of <br /> Page 2 of 5 <br />
