The City Code further states in Section 17-7.7 SANITATION STANDARDS that "All solid waste shall be disposed of in accordance with the standards of Crow Wing County. " I have been to your property and taken the enclosed pictures. If these pictures accurately depict the condition of your property, I would have to find that you are in violation of these four provisions of the City Code. As opposed to formally citing you for a violation of the City Code, we would like the opportunity to work with you to correct the situation. We are requesting that by no later than April 23,2009 you remove the garbage from the ground and place within acceptable garbage containers. In addition,there is to be no future disposal of garbage on the ground; all garbage and refuse must be placed within acceptable containers and hauled away. Failure to comply with the City Code by April 23, 2009 will prompt us to take more aggressive action. This would likely include administrative fines in the amount of $100.00 per day for each day the violation continues, civil action to obtain a court order directing you to comply with the City Code and could potentially include criminal action. You will be responsible to reimburse the City for any expenses incurred in remedying this violation. This would include any consultant fees or other professional services that City Staff determines is necessary, including but not limited to the City Planner at$92.00 per hour,the City Engineer at$93.00 to $148.00 per hour or the City Attorney at$145.00 per hour. Having garbage strewn about the ground as depicted in these photographs is not only an eyesore to the rest of the community, it is a safety issue that we take very seriously. Please understand our seriousness and commitment to uphold the City Code. We hope you will take this opportunity to work with us and resolve this matter.
