could resolve the issue. Landsburg Landscape Nursery had constructed the berm
for the previous owner. They may be able to help you with either the swale or a
rain garden. At a minimum a swale must be constructed to slow the flow of
stormwater toward the lake.
5. Hot tub: The dwelling is a non-conforming structure as it does not meet the 75-
foot setback from the OHW. You had requested permission to construct a
platform for the hot tub at the northeast comer of the dwelling. The structure for
the hot tub must meet the 75-foot setback from the OHW. You could apply
for a variance to construct the hot tub structure. The fee for a Variance is$350.00
plus a recording fee of$46.00. Application for a variance does not ensure
approval. To be approved for a variance, you must demonstrate a hardship unique
to your property. Additionally, you are not eligible to apply for a variance until
this outstanding enforcement issue is resolved.
6. Increased parking: You requested permission to increase the parking area next to
the existing driveway. I computed the existing impervious coverage and you now
exceed the allowable amount. Without a variance, you would not be allowed
to increase your amount of impervious coverage, so additional parking would
not be allowed.
7. City Lien: Due to the previous owner's bankruptcy and the foreclosure sale, the
City will not be able to recover the monies owed by them.
I
If you have any questions, please do not hesitate to contact me.
I
Sincerely,
,
 i
Dawn Bittner
Zoning Administrator
C: Planning Commission
