May 21, 2015 Staff Report Page 3

6.3. Ordinance Amendment Regarding Public Use in Business Park

Dawn Bittner explained that the Planning Commission is recommending an
ordinance amendment to exclude public use in the light industrial zone
based on the following findings of fact:

1. The amendment reserves all space within the Industrial/Business
Park for uses that will pay property tax and will employ people.
2. The amendment is in conformance with the Comprehensive Plan.

COUNCIL MEMBER LOUKOTA MOVED TO ADOPT ORDINANCE 15-02
AMENDING CHAPTER 17 OF THE CITY CODE REGARDING PUBLIC
USE IN THE LIGHT INDUSTRIAL ZONE BASED ON THE FINDINGS OF
FACT LISTED IN THE MAY 5TH COUNCIL REPORT. COUNCIL MEMBER
PEDERSON SECONDED THE MOTION. MOTION CARRIED 5-0.

6.4. Ordinance Amendment Regarding the Transition Residential Zoning
Classification

Dawn Bittner explained that the Planning Commission is recommending an
ordinance amendment to Chapter 17 based on a disparity in the minimum
lot area and maximum accessory structure size in the Transition Residential
Zone. The Planning Commission based its recommendation on 3 findings of
fact:

1. The purpose and intent of the Transition Residential zone is to
provide a residential zoning classification that serves as a medium-density
buffer between areas of higher density and areas of lower density.
2. There is a disparity in the minimum lot area for the Transition
Residential zone requiring 10 acres when it should serve as a medium-
density buffer between Rural Residential requiring 5 acres and higher
density areas such as Urban Residential.
3. The amendment creates a more flexible ordinance that allows
property owners the ability to construct larger accessory structures.
Structure size will remain limited by the maximum impervious surface
coverage requirement.

COUNCIL MEMBER LOUKOTA MOVED TO ADOPT ORDINANCE 15-03
AMENDING CHAPTER 17 OF THE CITY CODE REGARDING THE
TRANSITION RESIDENTIAL ZONING CLASSIFICATION BASED ON THE
THREE FINDINGS OF FACT STATED IN THE MAY 5TH COUNCIL MEMO.
MAYOR SJOBLAD SECONDED THE MOTION. MOTION CARRIED 5-0.

MAYOR SJOBLAD MOVED TO AUTHORIZE SUMMARY PUBLICATION
OF ORDINANCE 15-03 AMENDING CHAPTER 17 OF THE CITY CODE
