IV. TERM <br /> This Agreement shall continue until terminated as provided hereinafter. <br /> V. DISBURSEMENT OF FUNDS <br /> All funds disbursed by the County or City pursuant to this Agreement shall be <br /> disbursed pursuant to law. Upon project completion, a final cost accounting will be performed <br /> totaling costs related to the Project. An invoice will be prepared by the County and submitted to the <br /> City. As shown in Section III,the total estimated cost to the City is currently$0.00,subject to change <br /> dependent upon future City requests. <br /> VI. CONTRACTS AND PURCHASES <br /> All contracts let and purchases made pursuant to this Agreement shall be made by the <br /> City and County in conformity with State law. <br /> VII. ACCOUNTABILITY <br /> An accounting shall be made of all receipts and disbursements upon request by either <br /> party. <br /> VIII. TERMINATION <br /> This Agreement may be terminated by either party only for breach of this Agreement <br /> or by mutual consent of the parties. <br /> IX. FUTURE MAINTENANCE —The maintenance requirements listed below are attributable <br /> to facilities on County Roadways within the City Limits of Pequot Lakes. Any maintenance <br /> requirements associated with the proposed four-lane segment of TH 371 will be covered under <br /> separate agreements between the State and City. <br /> A. STORM SEWER SYSTEM -The maintenance of the completed storm sewer system <br /> for all phases of the project, including manholes, catch basins, catch basin leads, <br /> trunklines and detention basins (including ponds and their outlet structures) installed <br /> as part of the Project shall be the responsibility of the City. Routine maintenance is <br /> considered all procedures required to keep the system in working order as designed. <br /> Rehabilitation of pipes and structures within the existing and future County right-of- <br /> way shall be the responsibility of the County. <br /> B. SIDEWALK/TRAIL SYSTEM - The City shall be responsible for the perpetual <br /> maintenance of all trail/sidewalk systems and maintain them in such a condition to <br /> provide for safe use by the public. This shall include, but not be limited to ADA <br /> crossings, drainage and erosion, snow and ice control/removal, sweeping and debris <br /> removal, patching, crack repair, pavement replacement, trail side mowing, signing, <br /> pavement markings and future replacement/rehabilitation of the trail/sidewalk <br /> infrastructure. The County shall notify the City of any unsafe condition that comes to <br /> its attention and the City will cause the unsafe condition to be corrected within a <br /> reasonable period of time.
