not been made within a reasonable time,the County Engineer shall cause the trail to be <br /> closed to the public until said unsafe conditions are corrected. The County may, at its <br /> discretion, correct the unsafe condition. The City is responsible for all costs incurred <br /> by the County in correcting any unsafe condition. <br /> Costs to repair any damage to the trail caused by the County performing needed <br /> maintenance or reconstruction of the roadway, storm sewer, curb and gutter or any <br /> other portions of the roadway system, shall be the responsibility of the City. Cost to <br /> repair any damage caused by negligent actions of the County shall be repaired by the <br /> County. This does not make the County responsible for inspection of the trail for <br /> unsafe conditions. The County will provide no maintenance or reconstruction services <br /> for the sidewalk/trail systems or the Paul Bunyan State Trail. <br /> C. ROUNDABOUT INTERIORS-The City shall be responsible for general maintenance <br /> of the interior of the roundabout intersections. Maintenance includes,but is not limited <br /> to, vegetation control, litter and debris removal, removal and replacement of all dead <br /> or diseased plantings, and any other maintenance activities necessary to perpetuate the <br /> landscaping in a safe, usable and aesthetically acceptable condition. Any <br /> appurtenances, structures, landscaping, etc. to be placed within the roundabout shall <br /> have prior authorization from the County. <br /> D. STREET LIGHTING - The maintenance and power costs of any street lighting <br /> (proposed or future)will be the responsibility of the City. Maintenance of the lighting <br /> system includes everything within the system, from the point of attachment to the <br /> power source to the last light on the feed point including re-lamping of lighting units <br /> or replacing of LED luminaires,and repairs to any part of the system causing an outage. <br /> The City shall also be responsible for Gopher State One Call (GSOC) locates and <br /> painting of poles and other equipment.The City shall become the owner of the lighting <br /> systems installed. The County shall be responsible for the initial hook up cost and <br /> application to secure an adequate power supply to the service pad or pole. The County <br /> shall also be responsible for knockdown replacements of the lighting system. <br /> E. ROADWAY MAINTENANCE — Except as noted in Section IX above, each agency <br /> shall perform standard roadway maintenance on their individual roadways based upon <br /> their practices and policies. <br /> X. NOTICE <br /> For purposes of delivery of any notices hereunder, the notice shall be effective if <br /> delivered to the County Engineer of Crow Wing County, 16589 CR 142,Brainerd, Minnesota, 56401, <br /> on behalf of the County, and the City of Pequot Lakes, 4638 County Road 11, Pequot Lakes, MN <br /> 56472, on behalf of the City. <br /> XI. INDEMNIFICATION <br /> The City and the County mutually agree to indemnify and hold harmless each other <br /> from any claims, losses, costs, expenses or damages resulting from the acts or omissions of the <br /> respective officers, agents, or employees relating to activities conducted by either party under this <br /> Agreement. <br /> 4 <br />
