City Council Minutes June 16, 2015 Page 2 of 4 WING COUNTY AND THE CITY OF PEQUOT LAKES. COUNCIL MEMBER AKERSON SECONDED THE MOTION. MOTION CARRIED 3- 0. 3. MnDOT Agreements— Highway 371 3A. Joint Powers Agreement Tim Houle explained that the Agreement addresses the spray irrigation field issues as well as the conveyance by MnDOT of two parcels to the City (the "Moberg" parcel off the southwest side of the existing spray irrigation field and the "Tree Farm Road" parcel south of Tree Farm road and north of the existing wastewater stabilization ponds). Tim Houle also explained that the Agreement provides for money to be conveyed to the City from MnDOT because of the highway going through the irrigation field and because of the accelerated timing of the project. He explained that because the City is acquiring two parcels of land, a 4/5th vote of the Council is required. Council Member Karr arrived at this time (6:23 p.m.). COUNCIL MEMBER LOUKOTA MOVED TO ADOPT RESOLUTION 15- 15 BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PEQUOT LAKES, MINNESOTA, APPROVING A JOINT POWERS AGREEMENT WITH MN/DOT FOR WASTEWATER SPRAY IRRIGATION MITIGATION AND THE ACQUISITION OF CERTAIN REAL PROPERTY FROM MNDOT AND DISPENSING WITH REVIEW OF THE ACQUISITION BY THE CITY OF SAID REAL PROPERTY BY THE PEQUOT LAKES PLANNING COMMISSION. COUNCIL MEMBER KARR SECONDED THE MOTION. MOTION CARRIED 4-0. 3.B. Cooperative Construction Agreement Mayor Sjoblad stated that this Agreement addresses several turn backs of roadways, the new signal at Myers Road and CSAH 16, and various City maintenance requirements. MAYOR SJOBLAD MOVED TO ADOPT RESOLUTION 15-16 ENTERING INTO A COOPERATIVE CONSTRUCTION AGREEMENT RELATING TO THE HIGHWAY 371 PROJECT BETWEEN THE MINNESOTA DEPARTMENT OF TRANSPORTATION AND THE CITY OF PEQUOT LAKES. COUNCIL MEMBER KARR SECONDED THE MOTION.
