16.2 Seniority list. The seniority list on the effective date of this Agreement shall show the name, hire <br />date, and job title of all employees in the bargaining unit. The Employer shall keep the seniority <br />list up to date, in addition to posting the list on the employee's bulletin board on the first working <br />day of each year for a period of fourteen (14) working days and shall send a copy to the Union. <br />(Initial seniority list to.be prepared by Union, subject to Employer review and approval:) <br />Employees shall have fifteen (15) working days from the date of the posting to supply written <br />documentation, proof, and a written request for seniority change to the Employer. <br />16.3 An employee shall lose seniority for any of the following reasons: <br />a. Resignation; <br />b. Discharge for Just cause; or suspended without pay for "just cause"; <br />C. Failure to return to work when recalled from layoff, <br />d. Failure to be recalled from layoff within one (1) year; <br />e. Failure to return to work upon expiration of an approved leave of absence. <br />16.4 Application of Seniority Seniority shall apply where specifically provided in this Agreement. <br />No part-time employee shall supersede any full-time employee in seniority. <br />16.5 No regular employee shall be laid off while a probationary employee is working and provided the <br />senior regular employee is qualified to perform the work available. Layoff shall be according to <br />seniority within job classification. Probationary employees shall be laid off first. Thereafter layoff <br />shall proceed in inverse order of seniority and recall shall be in the reverse order of layoff within <br />a classification. Notice Of recall shall be sent to employees, at their last known address as on file <br />with the Employer, by registered or certified mall. If the employee falls to report for work within <br />ten (10) calendar days from the date of mailing of the notice of recall, the employee shall be <br />considered to have resigned. Employees shall have the right of recall for a period of one (1) year <br />from the initial layoff date. <br />ARTICLE 17 <br />OUTSIDE EMPLOYMENT <br />17.1 Employees may accept outside employment during the employee's off duty hours, provided such <br />employment is not illegal and would not bring discredit to the employee's position, or to the <br />Pequot Lakes Police Department. Employees must notify the Police Chief or designee, in writing, <br />prior to commencing such employment and may be required by the Police Chief or designee to <br />justify continued employment if the Police Chief or designee believes the employment presents a <br />conflict of interest or if the Police Chief or designee has other valid objection to the employment. <br />An employee may not hold himself/herself out as a City employee to his other employer or to the <br />public when engaged in outside employment. Such secondary employment cannot interfere with <br />the operation of the department or interfere with the employee's ability to meet employment <br />16 <br />
