14.3 Injury on Duty; The parties recognize that employees working in law enforcement and covered by <br />this Agreement face a high potential for injury due to the nature of their employment. Such <br />employee who, in the ordinary course of employment and while acting in a reasonable and <br />prudent manner and in compliance with the established rules and procedures of the Employer, <br />incurs a disabling injury while in performance of assigned duties involving enforcement <br />investigation or assistance shall be compensated in an amount equal to the difference between the <br />employee's regular rate of pay and benefits paid under worker's compensation, without deduction <br />from the employees accrued sick leave. For employees receiving benefits under the Worker's <br />Compensation Law, due to an injury sustained in the performance of duties unique to law <br />enforcement the City shall pay one- third (1/3) of scheduled work hours and Worker's <br />Compensation shall pay two-thirds (2/3) beginning on the first day of lost time. The employee <br />will accrue health and welfare and all other accrued benefits on the same basis as he/she would <br />accrue on active status unless otherwise limited as in the case of retirement benefit formulas. <br />Effective on the thirty-first day, compensatory time off accumulated will be used to make up the <br />difference between such benefits and the employee's normal net earnings for each pay period. <br />After all accumulated compensatory time is used sick leave or vacation time may be used to make <br />up the difference between such benefit and the employee's net earnings based on eighty hours <br />(80) for each pay period. <br />14.4 All other leaves will be administered.in accordance with the City's Personnel Policies. <br />ARTICLE 15 <br />PROBATIONARY PERIODS <br />15.1 Probationary Period. All newly hired or rehired full-time employees shall serve a (12) month <br />probationary period. The probationary period may be extended for up to six (6) calendar months <br />for full-time and part-time employees by action of the City Council after conferring with the <br />Union. <br />15.2 Dismissal., At any time during the probationary period, the Employer shall have the unqualified <br />right discharge; and during this probationary period, the employee shall have no recourse to the <br />grievance procedure, insofar as discharge is concerned <br />15.3 Benefits. Vacation and paid sick leave shall accrue, but may not be taken while the employee is <br />on probation without specific permission of the chief of police. Payment will be made for <br />holidays that occur during the probationary period. <br />15.4 Upon successful completion of the probationary period, an employee shall become a regular <br />employee within the meaning of this Agreement. <br />ARTICLE 16 <br />SENIORITY <br />16.1 Definitions. Seniority shall be defined as an employee's length of continuous service with the <br />Employer. Upon completion of the probationary period, the seniority date of the employee shall <br />relate back to the employee's initial date of most recent employment. <br />15 <br />
