ARTICLE 15 <br />GENERAL LEAVES <br />15.1 Employment Notification- Any employee leaving the municipal service in good standing and <br />upon completion of the probationary period, after giving at least fourteen (14) working days <br />advance notice to the Employer, shall be compensated. for vacation, compensatory time, personal <br />leave, sick leave accrued and unused to the date of separation. Failure to comply with this <br />procedure may be considered cause for denying the employee future employment by the City and <br />the employee shall be deemed to have left in bad standing. <br />15.2 Absence Without Leave; Any employee absents from scheduled duty that is not reported to and <br />authorized by the Employer shall be deemed an absence without leave. An employee absent <br />without leave will be subject to disciplinary action. An employee absents without leave for two <br />(2) consecutive days shall be deemed to have resigned employment. The Employer may grant <br />approval for the leave subsequent to the unauthorized absence, if the Employer determines the <br />circumstances surrounding the absence warrant such action. <br />15.3 Injury on Duty; The parties recognize that employees working in law enforcement and covered by <br />this Agreement face a high potential for injury due to the nature of their employment. Such <br />employee who, in the ordinary course of employment and while acting in a reasonable and <br />prudent manner and in compliance with the established rules and procedures of the Employer, <br />incurs a disabling injury while in performance of assigned duties involving enforcement <br />investigation or assistance shall be compensated in an amount equal to the difference between the <br />employee's regular rate of pay and benefits paid under worker's compensation, without deduction <br />from the employees accrued sick leave. For employees receiving benefits under the Worker's <br />Compensation Law, due to an injury sustained in the performance of duties unique to law <br />enforcement the City shall pay one- third (1/3) of scheduled work hours and Worker's <br />Compensation shall pay two-thirds (2/3) beginning on the first day of lost time. The employee <br />will accrue health and welfare and all other accrued benefits on the same basis as he/she would <br />accrue on active status unless otherwise limited as in the case of retirement benefit formulas. <br />Effective on the thirty-first day, compensatory time off accumulated will be used to make up the <br />difference between such benefits and the employee's normal net earnings for each pay period. <br />After all accumulated compensatory time is used sick leave or vacation time may be used to make <br />up the difference between such benefit and the employee's net earnings based on eighty hours <br />(80) for each pay period. <br />15.4 All other leaves will be administered.in accordance with the City's Personnel Policies. <br />ARTICLE 16 <br />PROBATIONARY PERIODS <br />16.1 Probationary Period. All newly hired or rehired full-time employees shall serve a (12) month <br />probationary period. Part-time employees shall serve a probationary period consisting of one <br />thousand forty (1040) hours or one (1) year of employment with the employer, whichever occurs <br />15 <br />
