10.3 Ordinance Amendment - Utility Disconnection Process

B. The customer shall have until the close of business on the last business day of April and/or August to pay the past due amount plus any current amount due. C. If the account is not paid in full by the close of business on the last business day of April and/or August, the customer's utility service may be disconnected on the second business day of May and/or September or as otherwise provided in the disconnection of water service notice. Disconnections shall not occur on Fridays, holidays, or during the period from October 15 through April 15 (the cold weather rule). D. Before disconnection of water service to a property, a second notice of disconnection of water service shall be provided to the owner of record and occupants of the property at least ten (10) calendar days prior to the date of disconnection of service. The City shall hang the red disconnect notice in at least one conspicuous location in or on the customer's building. The notice shall state the following: (1) The City intends to disconnect water service due to delinquent payments; (2) The proposed disconnection date; and (3) The total amount due to avoid disconnection, categorized as the amount past due, the amount currently due, and any applicable late fees, service charges, interest, or penalties; E. If the City does not receive payment or a demand for a hearing by the appeals deadline, the City may disconnect water service. If an appeal is made prior to the appeal deadline, the Council shall hold a hearing on the matter no later than thirty (30) days after receipt of the appeal. A notice of the date, time, place and purpose of the hearing by the Council shall be mailed not less than ten days prior to the hearing to the person who filed the appeal. No action shall be taken by the City to terminate the service, certify to the county for collection, or exercise other remedies until the appeal is decided by the Council. After hearing the oral and written statements of the person filing the appeal, other interested persons and city staff, the Council shall make its decision at the same meeting or at a specified future meeting. F. If a customer receives a disconnection notice and desires to make payment arrangements, the property owner shall call City Hall to make such request prior to the disconnection date. A one -month extension may be considered if the account will be paid in full by the close of business on the last business day of the fourth month. If an extension is granted, but the account is not paid in full, the customer's utility service may be disconnected on the second business day of the fifth month. K
