A title opinion dated August 25, 2023, for the development has been <br />reviewed and accepted by the city attorney. <br />12. The estimated cost for the proposed public improvements (road) within the <br />development is $249,569.90. The city engineer recommends a bond (or <br />other financial assurance acceptable to the city attorney) in the amount of <br />$312,000 ($249,569.12 x 1.25 = $311,962.38, rounded up). <br />13. A development contract is required for the development. Prior to city <br />execution of the final plat document the developer shall enter into a <br />developer’s agreement (including financial security) with the city for <br />construction of public improvements approved by the city engineer <br />14. The applicant has submitted an independent third-party plat check dated <br />August 24, 2023, from a licensed land surveyor, Amanda J. Brustad, <br />License No. 47934. <br /> <br />COUNCIL MEMBER PEDERSON MOVED TO APROVE THE FINAL PLAT OF <br />THE HOMES ON FIREWATCH WAY BASED ON FOURTEEN FINDINGS OF <br />FACT AND TWO CONDITIONS OF APPROVAL. COUNCIL MEMBER SEILS <br />SECONDED THE MOTION. MOTION CARRIED 4-0. <br /> <br />6.3. Planning Commission Appointment <br /> <br />Mayor Gardner recommended appointing Paula Lang to the open seat on the <br />Planning Commission Board. <br /> <br />MAYOR GARDNER MOVED TO APROVE THE APPOINTMENT TO THE <br />PLANNING COMMISSION BOARD. COUNCIL MEMBER SEILS SECONDED <br />THE MOTION. MOTION CARRIED 4-0. <br /> <br />7. Fire <br /> <br />7.1. Fire Department Report <br /> <br /> No report. <br /> <br />8. Police <br /> <br />8.1 Police Department Report <br /> <br /> The September 2023 Police monthly report is attached for Council review. <br /> <br />8.2 SRO Update <br /> <br /> Police Chief Davis states there have been no notable changes. He believes the <br />current position is the right path to continue. It is already law, and the Attorney <br />General cannot change that. However, every attorney interprets that information <br />differently. He said Crosby and Brainerd are going to be putting their SRO back <br />into the school, but he doesn’t want to take that chance of being the first one to <br />have something happen with the law written the way it currently it.
