The Cease and Desist was issued for construction the SIZ in November, 2007. On <br /> `-- December 6, Mr. Steffens applied for a permit to construct Unit 21. A letter was sent <br /> to Mr. Steffens stating that no permit could be issued with a Cease and Desist on the <br /> property. On December 13 the Planning Commission discussed the Cease and Desist <br /> on the beach, stated it would be done in the spring and requested that they be allowed <br /> one permit to construct Unit 21 during the winter months. There was a condition <br /> included to obtain written resolution to the matter. He conveyed to Mr. Steffens that <br /> the Cease and Desist had been lifted and should be allowed to get this one building <br /> permit based on the action of the Planning Commission. No written resolution <br /> received by City. Staff issued permit to restore beach area. <br /> No permit was issued for Unit 21. Mr. Steffens applied previously. Mr. Steffens <br /> proceeded to construct Unit 21 without a permit. They never received the permit as <br /> city never issued the permit. <br /> No new application made for Unit 21 after Dec 13 Planning Commission meeting. <br /> They started construction in December and finished in May. <br /> Dec 13 Planning Commission was to lift violation and approve the permit. No <br /> written resolution received until May 30. No fees received by the City for the Land <br /> Use Permit to construction Unit 21.. <br /> There was no malicious intent. Mr. Steffens should have re-applied for permit. <br /> The After the Fact fine on Olson road was not 5 time the original fee. To check this <br /> one off, do we just pay permit cost or establish an After the Fact fee? <br /> Issue#2: Construction without a permit—A motion was made by Mark Hallan, <br /> seconded by Bill Habein,to have Staff issue the permit for Unit 21 with an After the <br /> Fact fee of 2 times the original permit fee. A mistake was made and some type of <br /> attention getter is necessary,but not totally malicious because they have to build 40 <br /> more units and to make sure this doesn't happen again. All members voted "aye". <br /> Motion carried. <br /> Issue#1: Restoration of the beach areas: Some work has been done but progress has <br /> been agonizingly slow. Overall vegetation plan not presented yet. Grasses were <br /> planted but not cared for. More needed to be done. It is frustrating to not see <br /> progress move along more quickly. DNR coordination was location of docks only. <br /> There has not been a Cease and Desist issued within the last 40 days. Staff would not <br /> issue permits without concurrence of the Planning Commission. There are other <br /> violations on the property, such as the beach restoration is outstanding and not <br /> resolved, and clearing in the SIZ has not formally been documented. The Planning <br /> Commission can issue the permit, not Staff.
