4. Dan Helbling's letter—Annual review committee still meet sand there has been <br /> no response from Mr. Helbling. This tree removal is not being monitored. We <br /> reviewed submittals and they did meet the ordinance. The Plan is filed with the <br /> City and that is all that is required. Who enforces responsibility of the CUP? <br /> Staff directed to include CUP information in future monthly hearings. <br /> The following Potential Violations/Enforcement Actions were discussed. <br /> 1. Tom Steffens, Wilderness Resort Villas, LLC— <br /> Mr. Steffens and Jeff Miller were in attendance. Last month Mr. Steffens stated in a <br /> letter he would like to attend this meeting to discuss the Wilderness Resort property. <br /> There is frustration over beach area, construction of building,clearing in SIZ and <br /> completion of CUP conditions. <br /> Jeff Miller, WSN, stated he would address each of the points in the letter from Chuck <br /> Marohn and to establish a resolution to each of the items. The beach was constructed <br /> from a plan not revised after the City Council changed the Planning Commission <br /> decision. They admitted the error and commenced removal of area of beach. <br /> Attached to that permit was list of items they were going to do. Permit was issued on <br /> May 27 and it says to restore non permitted beach area as listed on the email from <br /> Chad Connor. That action took place and a meeting onsite. Silt fence was not <br /> properly installed and there needed to be additional seeding and plantings done. Silt <br /> fence was repaired and plantings and seeding took place at most improper time for <br /> growing season. Some of the plantings died in the process. This area had been <br /> reseeded and should resemble other areas in the spring. Not as natural as entire area, <br /> as it was used as beach and mooring area for the previous resort. This area is in <br /> packet and shown with pontoons and beach area with camper, dead trees and areas <br /> where boats were pulled up in that area. We are not ignoring the situation and seem <br /> we have not done to satisfaction of City. They have hired a landscape architect and <br /> plan an entire use for the entire area. He hopes to present that at the January meeting. <br /> The Planning Commission reminded Mr. Miller that approximately 1 %2 years ago, <br /> before the CUP and Plat were amended, he had stated he would keep the Planning <br /> Commission updated on an every other month bases, of the progress on the <br /> conditions. There were a lot of conditions where plans were to be developed, the <br /> vegetative for example, and be approved. Mr. Miller stated that there has not been a <br /> lot of activity taking place. <br /> When asked, Mr. Steffens stated he felt all of our discussions had been relayed by <br /> WSN to him. They acted as quickly as they could to remove the beach and were <br /> remiss and thought the Cease and Desist had been removed. <br /> Lifting of the Cease and Desist would be in writing from Staff. <br /> MINUTES 8 <br /> Pequot Lakes Planning Commission <br /> November 20, 2008 <br />
