Last month, the Council approved me sending Mr. Babinski a proposed Agreement on <br /> acquiring some permanent easement from him for continuation of the South Oak Street <br /> Improvements. <br /> I got delayed and did not get the letter to him until October 29. He did call me, though, this last <br /> Monday. Everything was fine but he wanted to make sure he did not get specially assessed. I <br /> told him that we could send him an Agreement with this in it. <br /> The letter I sent him is similar to the proposed Agreement with the School. Following are <br /> highlights of what I proposed to Mr. Babinski: <br /> a. The City will pay for all survey, easement description, and corresponding legal costs to <br /> describe, acquire, and record a permanent easement from Mr. Babinski to the City for the 33 <br /> feet along the western edge of your property from the north side of your property (south side of <br /> the School District property) down to the south side of your property (the platted Davis Street). <br /> This distance is approximately 980 feet, and so the area involved would be about 32,340 <br /> square feet or about 0.74 acres. <br /> b. The City will pay for salvaging and relocating the existing fencing along the western side <br /> of Mr. Babinski's property—just outside the new R/W- before construction begins to minimize <br /> the chances of anyone gaining access to his property. If any of it is damaged during this <br /> operation, the City will pay for new fencing to replace the damaged portions. For <br /> everyone's information, Mr. Babinski's existing north-south fence would be about 6 to 7 feet <br /> inside of the proposed R/W. <br /> c. Between the existing road and the new R/W line, the City will pay to clear and grub trees <br /> and do the necessary grading. <br /> d. The City will pay to construct all bituminous roadway, grassed roadside ditch, any storm <br /> drainage system improvements, and re-seeding of all areas disturbed by construction. <br /> e. After the fence is relocated by the City, Mr. Babinski would be responsible, as he <br /> was before, for maintaining his fence. <br /> f. After construction, including acceptable stands of seeded grass (at least 70% coverage <br /> per Minnesota NPDES General Stormwater Permit requirements), the City will maintain the <br /> bituminous roadway, the roadside ditches, any storm drainage system improvements, and <br /> all grassed areas inside the permanent easement obtained by the City. <br /> g. The City proposes the following compensation approach from information from the <br /> County Courthouse records: <br /> Donald S. Babinski 2007 Rev Trust, do Babinski Properties <br /> Parcel ID No. 290151300HY0009 and Parcel ID No. 290154200A00009 <br /> Deeded acres = 12.42 + 19.98 = 32.40 <br /> Estimated land value = $173,300 + $275,200 = $448,500 <br /> Value per square foot = $0.32 per square foot <br /> Roughly from the unimproved Miller Street down to Davis Street = 1,000 feet <br /> From the present property line, the City needs 33 feet to fit the road in <br /> 11/5/2008 <br />
