Every employee to whom Minnesota Statues 192.26 or 192.261 or USCA, <br /> Title 38 Section 2021 applies is entitled to the benefits afforded by those <br /> sections subject to the conditions therein prescribed. <br /> Leaves Without Pay <br /> The City Council may grant leaves to employees without pay under the <br /> following circumstances. <br /> 1. Regular Full Time Employees: The City Council may grant any <br /> regular full-time employee an educational leave or leave of absence without <br /> pay for a period not exceeding ninety (90) days, except that it may extend <br /> such leaves to a maximum period of one year if circumstances, in the City <br /> Council's judgment, warrant such extension. <br /> 2. Outside Employment During Leave: Employees on leave without <br /> pay may not take employment outside the city without prior approval by the <br /> City Council. Failure to get City Council approval for outside employment <br /> may result in termination. <br /> 3. Requests for Leave: Requests for leave of absence shall be made in <br /> writing at least sixty (60) days in advance, unless otherwise determined by <br /> the City Council. The City Council shall respond to each request for leave of <br /> absence in writing upon action at a City Council meeting. <br /> 4. Benefits: No employment benefits, vacation benefits or sick leave <br /> benefits shall accrue during a leave of absence without pay or on unpaid <br /> leave. Employees granted leave of absence must reimburse the City for their <br /> health and life insurance premiums, if applicable, for the entire duration of <br /> their absence. Payments shall be made prior to the first of each month for the <br /> next month's coverage. <br /> Jury or Witness Duty <br /> When an employee performs jury duty or is subpoenaed as a witness in court <br /> or voluntarily serves as a witness in a case in which the City is a party, the <br /> employee is entitled to compensation from the City equal to the difference <br /> between his/her regular pay and the amount received as a juror or witness. <br /> The time spent on jury duty or as a witness, except where the employee <br /> voluntarily serves as a witness in a case in which the City is a party, shall not <br /> 17 <br />
