Mr.Linnell
August 27,2008
damaged portions. If the School wants to have all new backstops or new irrigation systems,
the School will be responsible for the cost difference.
The term"reasonable costs"is used because the City, due to public bidding rules, will not be
able to hand pick their contractor for these kinds of work tasks. If the School wanted to take
care of this work, the City would ask that they have review and approval ability, since they
would be paying for these costs.
4. Between the existing School fence and the School District's south property line, the City will
pay to clear and grub trees, construct an aggregate surfaced parking area on the south edge of
the School's property, and re-seed areas disturbed by construction. The City will pay to adjust
the existing fence to allow for two 3-foot wide gaps for pedestrians. This work is being done
to replace the existing gravel/dirt surfaced parking area on the eastern edge of South Oak
Street—it should be a safer situation for everyone.
5. The City will pay to construct all South Oak Street bituminous roadway,South Oak Street
grassed roadside ditches, grassed storm drainage infiltration basin, any storm drainage system
, improvements, and re-seeding of areas disturbed by construction.
Present City rules indicate that property owners should take care of their own storm drainage
runoff.A large portion of the tributary,or runoff, area that goes to the proposed storm
drainage infiltration basin is from School District property.
As stated above, the City will construct and pay for the storm drainage infiltration basin and
any storm drainage improvements. The size of the basin should handle about a 10-year
rainfall event(this is an event that has a 10%chance of being equaled or exceeded for each
storm). Increased impervious area will lower the level of storm that can be handled.
The City agrees to look at planting approximate 6-foot tall trees at various points along the
side slopes of the infiltration basin.
6. Provided that the School District concurs on this agreement no later than the end of 2008,and
the City obtains favorable public bids in early 2009,the City agrees to have these
improvements constructed before the first home varisty football game in 2009.
7. After construction, including acceptable stands of seeded grass(at least 70%coverage per
Minnesota NPDES General Stormwater Permit requirements),the School District will
maintain the fencing,the ball diamonds,the backstops,the irrigation systems,the"agri-lime"
ilnui305-City of Pequot Lakek0130B0037-South Oak St-W Lake to Millek0130B0037.000South Oak St
Improvements■Correspondenc620080827--Mr Linnell at Schooldratt agreement for ROWltr.doc
