Union, work normally done or which could be done by employees covered by this <br /> Agreement; to determine the utilization of technology; to establish, modify, <br /> eliminate or otherwise change the organizational structure; to determine <br /> qualifications for positions, determine the content of any job and the duties <br /> assigned thereto, and the methods and techniques of work; to evaluate the <br /> performance of all employees; and to manage and administer the Employer's <br /> operations. <br /> ARTICLE 4 <br /> PRODUCTIVITY <br /> 4.1 Employees are expected to honor the principle of "A fair day's work for a fair <br /> day's pay." The continued success and operation of this Department is dependent <br /> upon delivery of excellent services to our citizens. <br /> 4.2 Employees are expected to be present for all scheduled shifts. <br /> 4.3 All employees are required to begin work promptly at their designated starting <br /> time, and upon completion of meal times and rest periods. <br /> ARTICLE 5 <br /> UNION SECURITY <br /> 5.1 Dues Check Off. The Employer shall deduct from the wages of employees who <br /> authorize such a deduction in writing, beginning with the first payroll period <br /> following the employee's first ninety (90) calendar days of employment, an <br /> amount necessary to cover monthly Union dues. Monthly dues so deducted, <br /> together with a list of employees from whom deductions were made, and the <br /> amount of such deductions, shall be forwarded to the Union within thirty (30) <br /> days. <br /> 5.2 Fair Share Fee. In accordance with Minnesota Statute 179A.06, subd. 3, the <br /> Union may require the Employer to deduct from the wages of each member of the <br /> bargaining unit who is not a member of the Union, a fair share fee. Such <br /> deductions shall be made in the same manner as dues under Section 1 of this <br /> Article. <br /> 5.3 The Union agrees to indemnify and hold the Employer harmless against any and <br /> all claims, suits, orders, or judgments brought or issued against the Employer as a <br /> result of any action taken or not taken by the Employer under the provisions of <br /> paragraphs 5.1 or 5.2 of this Article. --� <br /> 22794-1 (9.16.08) 3 <br />
