ARTICLE 2 <br /> EMPLOYER SECURITY <br /> 2.1 Neither the Union, its officers or agents, or any employee in the bargaining unit, <br /> will engage in, encourage, sanction, or support any strike, or the withholding in <br /> whole or in part of the full performance of their duties during the life of this <br /> Agreement, except as specifically allowed by the Public Employment Labor <br /> Relations Act of 1971, as amended. <br /> 2.2 The failure or refusal on the part of any employee to comply with the provisions of <br /> this Article 2 may result in immediate discipline up to and including discharge, <br /> which shall be subject to the grievance procedure. <br /> 2.3 In the event that an unauthorized strike occurs, the Union shall immediately: <br /> (1) Notify the Employer that such strike is unauthorized; <br /> (2) Order its members back to work; and <br /> (3) Advise the employees, in writing, that the strike is unauthorized and that <br /> employees are directed to cease such action and return to normal work. <br /> ARTICLE 3 <br /> �..- MANAGEMENT RIGHTS <br /> 3.1 The Union recognizes the right of the Employer to operate and manage its affairs <br /> in all respects, subject to compliance with applicable laws and regulations. All <br /> prerogatives, rights and authority which the Employer has not officially abridged, <br /> delegated or modified by express terms of this Agreement are therefore retained <br /> by the Employer. <br /> 3.2 The Employer retains the right to maintain and improve efficiency; to determine <br /> the quality and quantity of work performed; to hire, promote, demote, classify, <br /> transfer, layoff, and suspend employees, to discipline or discharge any employee <br /> for just cause, and to retain employees; to determine the number of employees to <br /> be employed and the amount of supervision; to assign and delegate work; to enter <br /> into contracts for the furnishing and purchasing of supplies and services; to make, <br /> enforce and alter, from time to time, reasonable rules, policies and regulations, and <br /> to require employees to observe the Employer rules, policies and regulations, <br /> which rules, policies and regulations will be posted at time of implementation; to <br /> schedule work, to determine the number of hours to be worked, and the extension, <br /> limitations, curtailment or cessation of operations or any part thereof; to determine <br /> the methods and equipment to be utilized and the type of services to be provided; <br /> to change, modify, or discontinue existing methods of service and equipment to be <br /> used or provided; to contract or subcontract, after meeting and conferring with the <br /> 22794-1(9.16.08) 2 <br />
