first Wednesday following the first Council meeting after the service month is completed. i. This fee covers the cost of one full-time paralegal and one and one-quarter (1.25)attorneys. b. Hourly Rate. SPL shall charge One Hundred Fifty and No/100($150.00)per hour for any legal services provided to the City,if such services provided are beyond the services described in paragraph 3, above. The City Administrator of the city for whom the services are to be rendered, shall approve the services for which the hourly fee is proposed to be charged,prior incurring the costs of those services. c. Expenses.The City shall reimburse SPL for the reasonable and necessary costs and expenses in providing legal services under this Agreement. Such costs include,but are not limited to: postage, the cost of one-fourth (1/4) attorney subscription for legal research(Westlaw), costs for other third-party software related directly to the legal services provided under this Agreement,BCA costs, filing fees(if any), skip traces (as necessary), service of process outside Crow Wing County, record requests outside Minnesota, and any other costs and disbursements incurred while performing services provided under this Agreement. d. Expert Witness Fees. On occasion, it may be necessary to retain an expert witness to increase the likelihood of success in criminal matter. No expert witness shall be retained without prior approval from the City Administrator of the city for whom the services are to be rendered. The city for whom the services are to be rendered shall be responsible for any such expert witness fees. e. Fee Adjustments. The Fee stated in paragraph 4(a), above, shall be increased annually based upon the twelve (12) month average percent change of the Consumer Price Index,Midwest Region,in the previous calendar year. 5. Files and Records. SPL shall keep complete files and records for all matters handled for the City. SPL shall retain closed filed for five(5)years, after which all physical versions of such files shall be destroyed. 6. Reporting. SPL shall provide the City with an annual case load summary on or before November 15 of each year, for the services provided during the previous July 1 through June 30.SPL shall further provide case load summary information upon request of the City Administrator of the City. 7. Insurance. SPL shall obtain, at its own expense,malpractice insurance with a minimum of One Million and No/100 dollars($1,000,000.00)in coverage. SPL shall provide proof of coverage to the City upon request. SPL shall, at its own expense, provide its own auto insurance,worker's compensation insurance and any other coverage it deems necessary.
