CITY OF PEQUOT LAKES <br /> LEGAL SERVICES AGREEMENT <br /> This Legal Services Agreement ("Agreement") made this day of <br /> 2022,by and between the City of Pequot Lakes("City"), a Minnesota municipal corporation,and <br /> Severson Porter Law,P.A., ("SPL"), a Minnesota professional association. <br /> RECITALS <br /> WHEREAS,the City desires to have SPL provide prosecution services for the City,for all petty <br /> misdemeanors, misdemeanors, and applicable gross misdemeanors offenses, arising out of its <br /> jurisdiction,as set forth in this Agreement; and <br /> WHEREAS, SPL is willing to provide said prosecutorial services; and <br /> WHEREAS, the City and SPL desire to memorialize their understanding in this Agreement <br /> regarding the scope of work and fee arrangements for said legal representation. <br /> NOW, THEREFORE, , in consideration of the mutual covenants, agreements, representations, <br /> and warranties contained in this Agreement,the adequacy of which are hereby acknowledged,the <br /> parties hereby agree as follows: <br /> 1. Incorporation of Recitals. The above-stated recitals are a part of this Agreement and are <br /> specifically incorporated herein by reference. <br /> 2. Term of Agreement.This Agreement shall be effective January 1,2023 through December <br /> 31,2026. <br /> 3. Services Provided. SPL shall prosecute all petty misdemeanors,misdemeanors, and those <br /> gross misdemeanors offenses that may be prosecuted by the City under Minnesota Law, <br /> which occur within the jurisdictional limits of Pequot Lakes. Such matters include Driving <br /> After Cancellation — Inimical to Public Safety, theft cases between Five Hundred and <br /> No/100 dollars ($500.00) and One Thousand and No/100 dollars ($1,000.00), receiving <br /> stolen property, check forgery, financial transaction card fraud, school bus stop arm <br /> violations,no insurance,and gross misdemeanor violations of Minn.Stat. 169A. SPL shall <br /> also represent the City in all forfeiture matters arising from and related to a criminal matter <br /> prosecuted by SPL under this Agreement. <br /> 4. Compensation and Fees. SPL agrees to provide the above-stated services under the <br /> following terms and rates: <br /> a. Fee. The 2023 annual rate for the services provided under this Agreement shall be <br /> Eleven Thousand Two Hundred Eighty-seven and 50/100 dollars ($11,287.50), <br /> which shall be paid in monthly installments.
