City Council Minutes <br /> December 5,2022 <br /> Page 7 of 9 <br /> COUNCIL MEMBER CLEMENT MOVED TO APPROVE THE UPDATED <br /> POLICE CHIEF JOB DESCRIPTION. COUNCIL MEMBER SEILS SECONDED <br /> THE MOTION. MOTION CARRIED 5-0. <br /> 9. Public Works <br /> 9.1. Public Works Report <br /> The November 2022 Police Department Monthly Report was received by <br /> Council. <br /> 9.2. Non-Payment Utility Billing Procedures <br /> Mr. Spiczka stated that the policy has not been reviewed by legal yet but staff <br /> would like to make a recommendation to change the non-payment policy. He <br /> stated currently if a bill is not paid a customer eventually will get a red tag that <br /> tells them they are about to get shut off. He said then what happens staff <br /> receives a bunch of angry phone calls and it puts Andy in the line of fire because <br /> he has to go to somebody's yard and shut the water off. He said from a staff <br /> management perspective, he is a little bit concerned with the level of animosity <br /> staff is seeing with folks when their water gets shut off or when they get a red <br /> tag. Mr. Spiczka stated a lot of cities are moving to tax certification, which means <br /> it gets assessed to taxes. He said staff is looking to at a modified policy that <br /> includes shut offs only a couple times a year so we can control recovering some <br /> of the money in real time versus waiting for assessment and certification to <br /> happen which sometimes can get kicked down the road for 2-3 years. <br /> Andy Schwartz clarified that they would be looking to do shut offs in May and <br /> September instead of monthly. He said the City will still tax certify. He said this <br /> will avoid tagging in the winter because they do not want to shut off any freeze <br /> run accounts. Mr. Spiczka stated that staff does connect past due customers with <br /> organizations that do help with utility bills. Council consensus is to go forward <br /> with this approach and reach out to legal. <br /> 10. Administration <br /> 10.1. Administration Report <br /> Mr. Spiczka gave a verbal update. He discussed current staff absorbing the <br /> planning and zoning duties. He stated moving the Police Department downstairs <br /> is in the works. Discussion ensued with a workflow of duties with planning and <br /> zoning. Mr. Spiczka stated some of the septic duties along with inspections will <br /> move to Andy Schwartz once he is certified. He said for the short-term it is <br /> contracted out. He stated Jenny Peterson will be doing some of the day-to-day <br /> planning and zoning duties and enforcement will go to him. Council asked Mr. <br /> Spiczka to put these on paper. <br />
