Mr. Olson described that he is using the property as a repair service and storage for the <br /> vans. Mr. Olson also asked why his business is required to apply for a Conditional Use <br /> Permit. Mr. Burslie stated that the business requires a Conditional Use Permit due to it <br /> not specifically being listed in the land use matrix of the city ordinances,which the <br /> business falls into the"miscellaneous" category. <br /> Discussion ensued regarding the number of vehicles, parking restrictions, and <br /> conditional use permit application requirements. <br /> PUBLIC COMMENT OPENED: <br /> PUBLIC COMMENT CLOSED. <br /> A motion was made by Planning Commission Member Caouette, seconded <br /> by Planning Commission Member E. Larson,to approve the Conditional <br /> Use Permit request to operate a shuttle service in the Downtown Mixed Use <br /> zone,based on the following Findings of Fact: <br /> 1. The conditional use permit request is to allow a shuttle service in the Downtown <br /> Mixed Use zone. <br /> 2. The subject property is a conforming parcel. The property contains a single story <br /> structure. <br /> 3. The property is served by municipal water and wastewater. The public cost for <br /> facilities and services for the proposed development will not be detrimental to the <br /> economic welfare of the community. <br /> 4. The subject property contains adequate parking space. <br /> 5. The proposed"use"is considered"Commercial Use (Other, Not Classified)"and <br /> requires a conditional use permit. <br /> 6. Signage will be applied for under separate Land Use Permit meeting Section 17- <br /> 7.1 of the City Code. <br /> 7. The proposed use,with conditions, conforms to the Comprehensive Plan. <br /> 8. The adjacent property is zoned Downtown Mixed Use and Transition Residential. <br /> The proposed use is compatible with the existing neighborhood. <br /> 9. The proposed use,with conditions,will not be injurious to the public health, <br /> safety,welfare, decency, order, comfort, convenience, appearance, or prosperity <br /> of the City. <br /> 10.The conditional use,with conditions,will not be injurious to the use and <br /> enjoyment of other property in the immediate vicinity of the subject property. <br /> 11. The subject property is accessed via Front Street. There will be an increase in <br /> traffic due to the proposed use,but not a significant increase.
