c. The area of the subject property located south of Jack Pine Drive has a <br /> limited building envelope given that portion of the property is zoned <br /> "Rural Residential"which has a 25 ft side yard requirement. <br /> 7. The property owner proposes to use the property in a reasonable manner. <br /> Adjacent properties contain dwellings constructed within the 75-foot setback. <br /> The dwelling located on the property adjacent to the east of the subject property <br /> is located 58'from the OHW level with a roof"overhang"located 50'from the <br /> OHW level. The dwelling located on the property adjacent to the west of the <br /> subject property is located 53'from the OHW level. Other single family dwellings <br /> in the vicinity of the subject property also encroach the 75' OHW level setback <br /> requirement. <br /> 8. The deviation from the Code will still be in harmony with the general purposes <br /> and intent of the City Code and Comprehensive Plan. <br /> a. The proposed dwelling is consistent with the following policy contained in <br /> the comprehensive plan (Pg. 10): "Ensure that new housing is properly <br /> scaled to the neighborhood and designed in a way that enhances the public <br /> realm." The proposed dwelling is similar is size and architectural style to <br /> other dwellings in the vicinity of the subject property. <br /> 9. The variance will not create a land use not permitted in the Shoreline Residential <br /> zone. Single family dwellings are a"permitted use." <br /> 10.The variance will not alter the essential character of the locality as the <br /> neighboring dwellings are constructed within the lake setback. <br /> 11. The variance has not been made based on economic considerations. The existing <br /> overhead electric power line and relatively steep topography restricts the <br /> buildable lot area to the south. <br /> And subject to the following Conditions: <br /> 1. Existing trees and vegetation between the dwelling and the OHW as indicated on <br /> the Screening Plan shall remain in a live state to provide screening as viewed from <br /> the lake. In the event the existing trees and vegetation dies or is damaged by a <br /> natural event,additional trees and vegetation shall be planted to provide screening <br /> as viewed from the lake. <br /> 2. A deck/patio or any other impervious surface may not be constructed in the area <br /> located adjacent to the north of the dwelling. This area is designated for and must <br /> remain as a stormwater retention area per plans submitted. <br /> All members voted"Aye".
