CITY OF PEQUOT LAKES <br />RESOLUTION 09- <br />A RESOLUTION VACATING A PORTION OF FIRST STREET (ALLEY) <br />AND A PORTION OF SECOND STREET (SECOND AVENUE), <br />BLOCK ONE, <br />FIRST ADDITION TO COLE'S PLAT OF PEQUOT <br />CROW WING COUNTY <br />WHEREAS, The City Council of the City of Pequot Lakes has determined to vacate that portion <br />of First Street (Alley) and that portion of Second Street (Second Avenue), Block One, First <br />Addition to Cole's Plat of Pequot legally described as follows (the "Subject Property" or <br />N1.1 "Street "): <br />M <br />That part of the 16.00 foot alley as dedicated in the plat of FIRST ADDITION TO <br />COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying Northerly of <br />the Easterly extension of the South line of Lot 9, Block 1, said plat; and <br />That part of the East 15.00 feet of Second Avenue, as dedicated in the plat of FIRST <br />ADDITION TO COLE'S PLAT OF PEQUOT, Crow Wing County, Minnesota, lying <br />Northerly of the Westerly extension of the South line of Lot 9, Block 1, said plat; <br />And <br />WHEREAS, a public hearing was held on October 6, 2009 before the City Council in the City <br />Hall after due published and posted notice had been given by the City Clerk on September 17, <br />2009, including mailed notice to all property owners within the plat of FIRST ADDITION TO <br />COLE'S PLAT OF PEQUOT and adjoining properties and all interested persons were given an <br />opportunity to be heard at the City Council meeting; and <br />WHEREAS, the City reserves any existing easements over, under, and across the Subject <br />Property and in addition the City specifically grants and/or reserves an easement for drainage and <br />utility purposes over, under and across the Subject Property; and <br />
